I am a resident and home owner. I enjoy most people however the HOA board treat people terribly and abuse their power. I recently was told by the HOA to clean a drainage ditch that is a major roadway drainage structure. If this drain was not in existence then storm water would flood the roadway and multiple properties. This ditch also lies on the property line between my home and the neighbors with both properties being in the area of the complained overgrowth. Without doing any investigation into property lines or contacting the City of Benton they fined me $300. They did not fine the neighbor who shares the drainage area. They also told me in a phone conversation that it was the neighbors who complained. I spoke with the neighbors and this was untrue. After this I contacted the City of Benton who stated it was the City of Benton’s responsibility to maintain these drainage ditches and that they would be happy to clear it. So the HOA lied about who complained. They failed to make a 5 minute phone call to the City of Benton and instead harassed my family and fined us for something the City is responsible for. The irony is there have been blatant violations of HOA policy in my neighborhood regarding residences being effectively turned into apartment complexes with a revolving door of different individuals in and out. They have not done anything to address this for months. They also fail their own policies as one of the awnings at the playground was torn for months. I really don’t care but if they are going to harass me for a City of Benton issue then at least uphold your own standards. Such prejudice and selective reinforcement of policy is illegal and immoral. Many board members are developers or have relationships with developers. I’ll let the public judge why some of these individuals serve in these capacities given the above...
