Fraternal Order of Eagles 350 S. River Road — Local services in Bay City

At a funeral dinner today for an Eagles member at the hall (Bay City, MI) I was ordered to remove my drink (non-alchoholic grape RipIt) and my child's drink (red bug juice) in front of other mourners because the staff member in charge stated that this was a health department violation. As I have researched the subject LARA who maintains liquor licensing in Michigan actually allows for patrons to bring their own wine into establishments. Since when does someone on a power trip make up laws that are not on the books to enforce drink purchases during a funeral dinner?

The licensee shall not allow the consumer to remove a partially consumed bottle of wine brought by the consumer unless, the licensee or the licensee’s clerk, agent, or employee caps the bottle or reinserts the cork so that the top of the cork is level with the lip of the bottle. The licensee may charge a corkage fee for each bottle of wine brought by the consumer and opened on the premises by the licensee or the licensee’s clerk, agent, or employee.

I just spoke with the President of the Order in Bay City on the phone and he claims not to be a lawyer but claims it is illegal in all resturants. So by their definition of the rule (which is not a law on any books or any local health code) any bottle of formula for infants is illegal.

The President also stated that though it was a funeral dinner he was attempting to make a profit on drinks.
