Demanded that my wife and I sign a negligence waiver. As in, the negligence of her and her staff.
Let a horse off its lead to chase after a dog. Good thing it wasn't a human.
When asked about the legality of protecting herself from her and her staff's negligence, we were ordered to leave the property.
Section 6 of her so-called "hold harmless" waiver directly refers to the negligence of she and her staff.
When asked about it, she became defensive and irate, demanding that we leave.
Signing that waiver gives her the ability to be drunk driving a tractor, and if she hits and kills you, she's not held liable.
This waiver wasn't drafted by any intelligent lawyer, as negligence isn't something that can be waived in court. If you're negligent, no amount of signatures can protect you. The fact that it was even ASKED is a little scary.
I understand liability waivers. I get that accidents happen. ...but I refuse to sign a document giving the people in charge of my safety permission to be negligent with said safety, or the safety of my wife.
An investigation has been open into the legality of this form, as well as the legality of a training facility being used to board horses.
