This Dealer FINALIZED a transaction involving the sale of one of their classic vehicles involving a substantial cash difference plus a trade in of my classic vehicle and received all monies due and owing as agreed and the parties exchanged titles only to have the Dealer get Sellers Remorse and decide to cancel the deal. I've filed a complaint with both the NJMVC and also the B.B.B. of New Jersey as I refuse to renegotiate or revise the Bill of Sale (Contract) in any way and I consider the deal as Final and Complete! This Dealer has committed Fraud and Deceptive Trade violations and I would be very leary to do business with them. In my personal opinion they CAN NOT be trusted.
The Dealers response simply IS NOT accurate so I expand herein to my original review as follows:
This is a licensed and bonded Dealer who has an obligation to do any and all due diligence prior to finalizing and executing any sales contract.
I simply sent the Dealer photos I had in a file folder on my computer and not from any prior listings that I had nothing to do with nor were they my listings.
I simply represented that my vehicle was an original restored and real deal 1965 Mustang Fastback with matching numbers for what the vehicle Vin # states and the title states.
The Dealer had every opportunity to send someone of their choosing to inspect the vehicle prior to them making me an offer for trade in.
The Dealer is the one that came to me with an offer of trading in my vehicle plus $32,000 cash difference and while I wanted to only pay $25,000, I eventually after much back and forth agreed to their offer and I wired the $32,000 due and owing to their account and the title to the trade in was sent to them using their FED EX account per their request.
This is simply a case of Sellers Remorse and the Dealer now wants to undo a deal they agreed to in writing and Finalized and they received everything they demanded such as monies due and owing as well as the trade in title.
Nothing was misrepresented to them regarding the trade in and they had every opportunity to do their own Due Diligence and check out the trade in before they decided to FINALIZE the deal and they executed the contract.
They decided to instead do Due Diligence after the fact and they went and pulled up old car sale listings of supposedly the same trade in that had been placed by previous owners of allegedly this same vehicle years ago which I had nothing to do and I have no way of knowing if those listings were in fact this same vehicle.
I point out that their own sales contract states as follows:
"Purchaser agrees that this order includes all of the terms and conditions hereof, that this order cancels and supercedes any prior agreement written or oral. This order shall not become binding until accepted by the DEALER or his authorized representative. I make this purchase knowingly without any guarantee expressed or implied, by this dealer or his agent"
The same applies to the Seller and both parties executed the contract on or about 08/31/2024.
This is a Car Dealer who knows how to appraise vehicles and they relied upon establishing a value they deemed justified for my trade in and it was they that demanded I pay $32,000 cash difference plus the trade in and not I.
What they paid for their vehicle and what I paid for mine has nothing to do with the FINALIZED and executed Sales Contract.
I am demanding they fulfill the transaction and that they now deliver the 1968 Mustang along with the title to the same at their expense since they refused to release the vehicle to my transport which was scheduled...
Read moreStopped by to check out a gorgeous '59 Thunderbird I'd seen on a dealership Facebook post. Glad I did, it was a great experience. Ed chatted with me about the car, shared some technical details, was knowledgeable about the maintenance history on the vehicle, and allowed me a test drive. At NO point was he pushy or high-pressure like a "car salesman," but then again this isn't a corporate car dealership. In fact it's more like an auto museum, complete with some recent additions of period décor to accentuate the antique car collection for sale. The cars were fairly priced and well-displayed. I was pleased to see a number of Sold tags, because Ed appears to run a genuine and invested business for collectors, enthusiasts and hobbyists so I hope he continues to do well here.
I did not wind up buying the Ford because after my time behind the wheel I think I'd do better in a smaller classic car, or one that is a generation or two later (I came up on cars from the 70s, not 50s), but I wouldn't have known that without the opportunity to drive it.
