I have enjoyed the Moose for many years. Today I destroyed my Moose membership card that I recently renewed for 2 more years. I saw a Member referred to as Big Mike humiliate himself by berating a bartender for asking a habitual drunk how many drinks he has already consumed. He was rude and obviously ignorant to the law. He claimed to be an ex police officer which I consider was an attempt at humor. He cursed me out and would not have a civil discussion as ignorance breeds hate. In Florida, a bartender has the right to ask a customer how many drinks they've consumed as part of their responsibility to prevent over-serving alcohol. Florida's dram shop law (Fla. Stat. § 768.125) holds establishments liable for knowingly serving alcohol to a person who is "habitually addicted" to alcohol or visibly intoxicated, if that person later causes injury. Asking about prior consumption helps bartenders assess intoxication levels to comply with this law and ensure public safety. While customers aren’t legally required to answer, bartenders can refuse service based on their judgment of intoxication, as supported by Florida’s alcohol service regulations and general premises liability principles.
