Bush’s DOES NOT abide by the law! I was just turned away from being served by the General Manager who identified himself as Nick for having my service animal with me. THIS IS NOT OKAY!!!!
Food Establishments (Texas Health and Safety Code, Section 437.023) • A food service establishment, retail food store, or other entity may not deny a service animal admittance into an area of the establishment or store or of the physical space occupied by the entity that is open to customers and is not used to prepare food.
Prohibited Discrimination (Texas Human Resources Code, Section 121.003 - 121.006) No common carrier, airplane, railroad train, motor bus, streetcar, boat, or other public conveyance or mode of transportation operating in the state may refuse as a passenger a person with a disability because of the disability, nor may a person with a disability be required to pay an additional fare because of their use of a service animal, wheelchair, crutches, or other device used to assist them in travel. No person with a disability may be denied admittance to any public facility in the state because of their disability. No person with a disability may be denied the use of a white cane, assistance animal, wheelchair, crutches, or other device of assistance. A person with a total or partial disability who has or obtains a service animal is entitled to full and equal access to all housing accommodations, and may not be required to pay extra compensation or make a deposit for the animal but is liable for damages done to the premises by the animal except for reasonable wear and tear. A service animal in training must not be denied admittance to any public facility when accompanied by an approved trainer. A person may not assault, harass, interfere with, kill, or injure in any way, or attempt to assault, harass, interfere with, kill, or injure in any way, an assistance animal. A person is not entitled to make demands or inquiries about the qualifications or certifications of a service animal for purposes of admittance to a public facility except to determine the basic type of assistance provided by the service animal to a person with a disability. If a person's disability is not readily apparent, for purposes of admittance to a public facility with a service animal, a staff member or manager of the facility may inquire about: whether the service animal is required because the person has a disability; and what type of work or task the service animal is trained to perform. Penalties For and Damages Resulting from Discrimination A person, including a firm, association, corporation, or other public or private organization, or the agent of the person, who violates the above provisions, commits an offense. An offense is a misdemeanor punishable by: a fine of not more than $300; and 30 hours of community service for a governmental entity or nonprofit organization that primarily serves persons with disabilities or for another entity or organization at the discretion of the court, to be completed in one year. A person, including a firm, association, corporation, or other public or private organization, or the agent of the person, who violates the above provisions, have deprived a person with a disability of their civil liberties. If applicable, the person with a disability may maintain an action for damages in a court of competent jurisdiction, and there is a conclusive presumption of damages of at least $300 to the person with a disability.
ADA Requirements: Service Animals
This publication provides guidance on the term “service animal” and the service animal provisions in the Department’s regulations.
Beginning on March 15, 2011, only dogs are recognized as service animals under titles II and III of the ADA. A service animal is a dog that is individually trained to do work or perform tasks for a person with a disability. Generally, title II and title III entities must permit service animals to accompany people with disabilities in all areas where members of the public are...
Read moreSo my mom used to say, "If you don't have anything nice to say, then let them have it!" That's what I feel like doing with Bush's Chicken, at least this location. I understand that the lady who took our order is working on her PhD of Memorization Psychology but sometimes it's best to write down the order especially when I ask them if they need to write it down. Thankfully, my wife checked the bag before leaving and noticed missing items. However, about an hour South on our trip we noticed the cookies where missing from the kids meals. How tragic to hurt children this way. I feel Sally Struthers should have a television special titled "Why people at restaurants should write things down: Think of the children!" Oh well, a few jolly road trip songs made the kids forget the missing cookies for about 20 seconds. Other than screwing up our order, the food tasted good so I guess that's worth a couple of stars. Would have been a higher rating if the girl wrote down our order and got things right. This reminds me of one of those old Texas Lottery "What Are The Odds" commercials where the waitress is taking orders not writing it down and when asked if she needs to she replies, "Oh, I'll remember" when obviously she won't. Sigh, there are worse things in life to worry about and this is not...
Read moreI encountered the most PATHETIC customer service attitude from an employee that I've ever experienced in a "fast food" restaurant before at Bush's Chicken in Lacy Lakeview. Some young man, whose name I was told is "Josh", that had the title Manager on his red shirt, but was later told by another young man who said he was the actual Manager who did not have that title on his gray shirt, is a person who has no business waiting on the public at all. I was kept waiting for my complete order, which amounted to almost $80 dollars, while he finished other orders for people that arrived after me, as he threw portions of my order up onto the counter from time to time never giving me any indication of why this was taking place. After waiting for around 10 minutes at the counter for my order to be completed, the gray shirt Manager asked if I still needed anything else, at which time, being unavoidably upset, I told him that I still needed 3 more items to finish the order that should have been handled long ago. Finally, the order was finished without any apology whatsoever for my inconvenience from either man other than being given a very weak excuse by the gray shirt Manager that it was their mistake.
Do NOT do business with this...
