I ordered by telephone, using the prices advertised online as my guide. When I showed up in store to pay and pick up, the total cost I was asked to pay was roughly 50% higher than what I’d calculated based on the advertised prices. I informed the cashier that the total cost of my order was significantly higher than the total of the advertised prices of the items I’d bought. The cashier then informed me that the prices advertised online are not the actual prices, because the cost of the menus items have increased, but SILVESTRE’S hadn’t gotten around to changing the prices quoted online. I then insisted that the failure to update the prices was SILVESTRE’S fault, that I was offered the items I agreed to purchase at the prices advertised online, that those were the prices I agreed to, and that, according to US contract and sale laws (the Uniform Commercial Code), we (SILVESTRE’S and I) had a deal right at the time I ordered on the phone and when SILVESTRE’S accepted that order. I maintained further that, as such, SILVESTRE’S and I had a contract for the sale/purchase of the items at the advertised prices, and that by law SILVESTRE’S could not have unilaterally changed the price of the deal. Shockingly, the cashier then asked me to quote him the law, including the section of the Uniform Commercial Code, that says that a merchant is bound to sell a customer an item at the price at which the item was advertised and the price at which the customer agreed to purchase the item. So the responsibility was placed on me to research such a basic principle of US contract/sales law and point it out to the SILVESTRE’S. At that point I had had enough!
