The place is very beautiful and the food was great. Our server was very kind and professional. However, the management is not on the same level. For example, I took my wife and best friend this evening for dinner to this restaurant and ordered a Lambrusco. When the server poured the wine, he did not offer a taste and just poured our glasses and walked away. We tasted the wine and it was overly sweet and we did not like it. We ordered it expecting a nice place to have a nice Lambrusco but we were mistaken as the wine we were poured was cheap. I should mention that the menu only labels the grape names and not the actually name or region of the wines on the menu so you have to guess on what you are ordering.

So we kindly expressed that we didn’t like it and would prefer to order an deferent wine. Being in the hospitality and wine industry ourselves, we expected our server to understand and let us order a new wine. We were perfectly willing to pay for the bottle that we didn’t want in addition to the new bottle that we did want.

Instead, the manager and “sommelier” arrived to our table and proceeded to tell us that we didn’t know what we are talking about and that Lambrusco is a sweet wine. They were both aggressively impolite and pretentious even though we know very well that they were incorrect and obviously uneducated in wine and proper service.

Ayer por la noche fuimos a cenar, es un restaurante vanguardista, comida de buen sabor, muy buena ubicación, en este caso les dejare una estrella, me hicieron pasar una noche demasiado desagradable con el servicio, en una cena familiar, al momento de sentarnos y pedir una silla para bebes, se cayó un plato mientras acomodaba al bebe (no se quebró solo se cayó), después vino el capitán de meseros en forma de chiste o no sé cuál sería la intención diciéndole al bebe que estaba muy feliz por tirar su plato, desconozco la capacidad intelectual de esta persona, pero me figuro debería saber un bebe no razona ni hace las cosas con malicia, al finalizar la comida volvió a repetirle a mi bebe que estaba muy feliz por haberle tirado su plato, me imagino que esta persona no alcanzo a comprender que fue un accidente. Al momento de la cuenta el mesero me pregunto si deseaba que se aplicara cargo a mi tarjeta por el servicio con el 10 o 15 % le conteste que solo aplicara el cobro de la cuenta $1569.00 y le dejaría la propina en efectivo, decidí dejarle $ 100 pesos en efectivo, nuevamente vino el capitán de meseros y me dijo que la propina que yo estaba dejando no era el mínimo que es 10% no conforme con eso todavía me dijo que me podía llevar esos $100 pesos lo cual considero una falta de respeto, sin ética, de verdad no se qué clase de persona es este capitán de meseros, nos levantamos y nos fuimos, pasamos una noche con un pésimo servicio en una ocasión tan especial, cabe señalar que esta escena la vivió mi abuelita una señora de 85 años, mi suegra una señora de 60 años, mis cuñados mi esposa, mi hijo y yo, totalmente desagradable e inconforme con este servicio.

Entonces, ¿Es obligatorio dejar propina?

No, Ninguna ley exige el pago de propina, servicio o cualquier otro cargo adicional en establecimientos o restaurantes, incluso la Profeco exhorta a los consumidores a no dejarse presionar y levantar la queja correspondiente por esta causa.

Nadie puede hacerte un cargo extra por servicio de “propina” sin tu autorización, El artículo 10, de la Ley Federal del Consumidor, señala que los proveedores no podrán aplicar métodos o prácticas comerciales coercitivas y desleales, ni cláusulas o condiciones abusivas o impuestas en el abastecimiento de productos o servicios.

Recuerda que, disfrutar de una gran comida y buen servicio no te obliga a dar una gratificación, dejar o no es consideración tuya.

Si esto te pasa:

-Pregunta al mesero por qué hay una diferencia en el total de tu cuenta.

-Si te dice que es la propina, niégate a pagar tal imposición y pide hablar con el responsable del lugar.

-Explícale que la propina es voluntaria y no pueden obligarte a pagarla. Si el responsable te da el mismo argumento que el mesero, dile que sabes muy bien que es voluntaria, y tú como consumidor determinas si el servicio amerita o no una gratificación.

-Si aun así el gerente te quiere obligar a pagar propina, explícale que sabes tus derechos y que esa acción atenta contra la libertad de los consumidores.
