
I’m citizen who enjoys photography and have personally been harassed at this park. Lately, I’ve noticed a disturbing trend in our city parks: if I use a DSLR or mirrorless camera, I’m suddenly treated like a commercial operation even when I'm just photographing my cousin. You cannot legally ask for permits for non-commercial photography regardless of if you pose or use a DSLR: it is a violation of our first amendment rights and parks are banking on us not taking them to court because of this infringement. I've already been in contact with the Tulsa parks and Tulsa Mayor and they will be clarifying their park policy to not include non-commercial photography.
People using phones are left alone, even when they're recording video, posing groups, and using the exact same parks.
This double standard is not only unfair: it’s unconstitutional.
Kansas City’s current photography policies in places like Loose Park and other publicly funded areas allow staff to demand permits, fees, or even deny access based solely on what kind of camera someone uses.
Let’s be clear:
*A DSLR does not make you a business.
*A posed photo of your family is not a commercial shoot.
*A phone and a camera are both tools: neither changes your constitutional rights.
Under the First Amendment, photography is a protected expression in public spaces. Court cases like Berger v. Seattle and Glik v. Cunniffe affirmed that people have the right to document public life regardless of equipment.
We ask the City of Kansas City, Kansas City Parks & Recreation, and relevant leadership to:
Clearly define “commercial photography” and exempt personal photography regardless of gear.
Stop equating DSLRs and mirrorless cameras with commercial use.
Educate staff on legal distinctions between commercial and non-commercial activity.
