Beware. Terrible experience. I purchased a cup from Okie Mountain Trading’s online store and paid extra for the shipping. (I did not go with the cheapest option and instead selected the one that costed some more because that option said it would get the package to me in 3-4 days) I paid 9.95 for 3-4 day shipping service as indicated on their website. Today is the fifth day since the package left the store for delivery, and the package isn’t here. In fact, the last information on tracking is that the package left usps regional facility in Oklahoma. (I live on the East Coast.) I contacted Okie Mt Trading to inquire whether I would be eligible for the extra shipping paid because that extra amount was paid in consideration for the 3-4 day shipping. I could not believe the answer I got. They answered that I would have to deal with the issue directly with the USPS. I responded saying that I paid Okie Mountain and not the USPS when I made the purchase (in fact, I did not even know that they were using USPS until they shipped the item and provided me with the tracking information) so Okie Mountain is the one that needs to take the responsibility. To that, I was once again responded with nonsense based on no logical grounds. Okie Mountain said “how do you think shipping companies make money?” Their argument was that they do not make any profit from shipping so once the item is shipped and leaves their hand, their responsibility terminates. I had never seen anyone, let alone a merchant, believing as such. If that were true under the law, no merchant would be using trackable delivery option which almost always tend to cost more than nontrackable option. Moreover, it was the Okie Mountain website that said 9.95 shipping option would get me the item in 3-4 days, and I, as a consumer relied on that. I did not take a look at the USPS, and as mentioned above, Okie Mountain website does not even indicate, and therefore there was no way of me even knowing that USPS is the courier to be used for the delivery. Under such circumstances, it is absolutely absurd to argue that I entered a contract directly with the USPS and Okie Mt plays no role in the process and there for has no liability. Consumer Rights Act states that when I make a purchase, my legal contract is with the retailer, which means retailer is responsible for the safe delivery of the order. Retailer is still considered responsible for an item even once the item leaves their hands and handed over to a courier, meaning they are responsible until the item is delivered to the customer. I am very much frustrated by the merchant’s lack of understanding of its basic responsibility. On top of that, it persists on its wrong knowledge of the law. I understand that not everyone is a law expert. However, when what you stated on your website, a statement on which a consumer relied on turns out to be untrue, you need to take a responsibility. At least when the customer points out and clarifies the law, you need to notice your mistake or engage in legal research on your own to confirm if that is the correct law, and not insist on non-common sensical, groundless statement. At this point, I am not even sure if the package will eventually deliver (chance that it has been lost), and if it does not, I am not sure of Okie Mt will compensate for the nondelivery. Based on what had been insisting so far, it would not even refund even in case the item fails to deliver as it would argue in that situation that it’s responsibility terminated the moment the item left its hand and it was the USPS that did not fulfill the delivery and therefore it has nothing to do with the situation. As a result, I will be ripped off. There are many merchants that are reasonable, professional, and take responsibility in their business.
