Upon moving out of the Reserve at Lone Oak in San Antonio this past April, my family and I diligently documented the condition of the apartment through comprehensive before and after photos, supplemented by a video walkthrough conducted at the time of departure. We took these precautions to ensure transparency and accuracy in our move-out process.
To our surprise and dismay, we recently discovered that charges allegedly related to property damage have been sent to a collection agency without any prior notification from your office. This unilateral action has not only caught us off guard but has also raised serious concerns about the fairness and transparency of the process.
It is important to note that prior to moving into the apartment, we meticulously documented existing damages through written records and photographs, which were duly retained for reference. Furthermore, at the time of our move-out, we explicitly requested a walkthrough inspection to address any potential issues. We were informed that such inspections are conducted only after 48 hours post-move-out, a policy which we adhered to despite our relocation out of San Antonio.
Given these facts, it is evident that the claims of property damage are unjustified and lack substantiation. The lack of communication and procedural transparency in this matter is deeply troubling and requires immediate rectification.
Therefore, I kindly request the following actions to be taken promptly:
Immediate Suspension of Collection Proceedings: I request that all collection actions related to the alleged damages be suspended immediately pending resolution of this dispute. Upon reviewing the situation, it has come to my attention that there were no prior attempts made to contact me for payment regarding the alleged damages before involving a collection agency. According to Texas state law, there must be at least three documented attempts to contact the tenant for payment before any collection proceedings can commence. We did leave a forwarding address to April Gomez.
Review of Documentation: I urge you to thoroughly review all written documentation on record, which clearly demonstrate the condition of the apartment upon moving in. I do have photos taken of the apartment at move-in and a video at move-out. We requested a walk-through since we were relocating to another town. We were told that walk-throughs were only conducted 48 hours after a tenant moves out. There are emails and written documentation to Alma Paloma who was the apartment manager at the time in regards to the damages and cleanliness of the apartment. It was roach infested, the patio had crayon drawings, the bathtubs had hair from previous tenants, large crack in master bedroom door, the carpets were not new and some areas of the tile file were coming up along with wax drippings that had to be scrapped off different areas of the floor. We paid $300.00 to get the dryer repaired because of lack of maintenance staff. Alma even suggested that we purchase roach gel from Amazon even though we pay a $7.00 pest control fee each month. We always paid our rent on time and did not cause problems, my husband even repaired the pool pump a few times. We did not request any of our deposit back and as a reminder it cost us $3000.00 to move from one apartment to another. Unfortunately the staff is horrible, they are nice till until they hear something they donāt like and then get very confrontational and unwilling to help. I lived at this community for 3 Years 1 year I was in a 1 bedroom apartment when I was moving to my 2 bedroom apartment I had a set date, I was unable to move in due to them āputting in new carpetā. It was not, still had the bed marks from the previous owner and reaked of dog. 1 of the associates agreed with me the manager of course said she couldnāt smell anything. They finally shampooed it a week later after multiple complaints My A/C had been acting up for the last 3 months of my lease, every time they would come and fix it for it to only stop working the next day. Total of 6 times till it was finally fixed for good. Upon moving out, my apartment was cleaned by myself, everything removed, sweepād, no major or even little things on floor. They are trying to charge me a little over 500 dollars for shampooing the carpet, and cleaning out the microwave, and to repaint the whole apartment because of some small color markings on a small parts of one of the bedrooms. For reference when I moved out of my 1 bedroom I was only charged 50 dollars for new blinds, but now since Iām gone they wanna charge for everything. On various occasions the office had lost all paperwork and I would have to prove to them that my parking spot was mine or something I paid already was actually paid or one office staff would say one thing to only be completely wrong about and contradicted by another last minute. Only one on of those occasions did they agree to what the first associate said. Gates would work for one week and be out for a month, grass looks nice but unfortunately to many owners with dogs donāt pick up after them and itās never enforced. When it came to the apartment it was horrible, when I did my walk through the fridge was missing the handle, the microwave was missing the handle and the ice machine didn't work, and the vents had mold. When I submitted the tickets for all that. They said they didn't fix the microwave handles or the ice machines because they broke so much it was a waste to fix. All they did was put the handle for the fridge and paint over the mold on the vents. As the days went by it had got a little hot and the ac immediately froze. The ac never defrosted and wouldn't go below 76, as the days got warmer the ac just stayed with a brick of ice, I submitted so many tickets and they would come: the ac would work for a little but then it was back to being broken, there was also a roach infestation which I was never able to get rid of. The neighbors down stairs smoked both cigarettes and weed, and you could smell it up to my apartment. They do have internet but the internet is always lagging, when I got my water bill the water alone was $100 which bumped up my rent to a total of 1708$ which was insane to me because my water usage wasn't that much. Because of these constant problems I decided to term my lease early because I couldn't live with a broken ac, especially with summer coming up and me having my 2 children there while being pregnant. It's been 6 months and I have yet to receive a mail key to my mail box.If I could give 0 stars I would.
