Refused to allow a sample, citing “COVID”, with no logic behind it and also discriminating against those with a mask exemption. Not sure when this business became the law on public health and safety. For a company so strung up on upholding the mighty hammer of the COVID laws (which I agree are required for the health and safety of us all), they seem to be very particular about the ones they uphold. Doesn’t make a peep when customers aren’t social distancing or sticking to venue capacity limits. I expect nothing less than the owner to be unprofessional in their reply and to name-call and/or claim to be attempting to improve the health and safety of their customers. A little advice, stick to ice cream, you barely do that to a respectable standard. UPDATE: Looks like the owner got some sense spoken into him and wrote a semi-professional response as opposed to his original name calling which I’ve attached for reference. I've also attached images of some of my favourite responses of his. It's like watching a child whinge because they didn't get their way. Some great business advice mate, take feedback when and where you can. Threatening people with legal action for providing objective feedback......grow up. The fact remains that you pick and choose which health orders to uphold. You are discriminatory at best and clearly unable to accept feedback. Claiming not to allow samples because of mask-compliance is, again, a made up rule. The law clearly allows for masks to be removed for the purposes of eating whilst indoors. It is nothing short of humorous that you feel the world is out to get you with a “spate of negative reviews”. As opposed to getting defensive, take on board the objective feedback and do better.

Me and my wife came here and ordered a Banana split costing $12.50 and a choc mint sundae costing $12.50. This was my first time eating a banana split. Everything about this dish was amazing. All the flavours combined together perfectly, The chocolate, strawberry and peanuts were all perfectly balanced and there wasn't anything overpowering aspects within. The service was excellent as the young lady that served me was friendly which made the place feel warm and welcoming. If you are looking for somewhere that sells tasty icecream with good service and a perfect view then I would definately recommend checking this place out.

Breaking the law and discriminating against people who cannot wear a mask.

They overrule doctors who give an exemption to the sick and disabled who cannot wear a mask and refuse them entry. Mind you they cherry pick what they want. They don't social distance.

Owner was rude. Dismissive. And what he did was highly illegal.

The marina has been inundated with complaints but this business is still allowed to open and trade. Well The Human Rghts Commission will be contacted, will provide a case number which will be added to an existing class action law suit. They will be dealt with.

This business does not belong in our community.

Noting that I seem to not have the ability to reply to your reply, I will edit my response here as my final response..

Your assumption that I am not a local is testament to your overall misguided view about justifying your own actions. You need to be certain before you make decisions that effect your very own community.

I am a local Nelson Bay business owner and have family entrenched here for over 20 years. I am a true local sir.

Not sure what you mean by police checks. There was no mention nor need of any police checks. Not sure what you mean by this. Mask exemptions are a a doctors certificate.

Your house policy is simply discriminative. You are not allowing someone in your shop because of their medical history.. Its not their fault. But you have decided to judge them on that, buying into the notion that you know better than our medical experts. We as business owners have an obligation to our customers in general, but especially our local customers. I've been coming to your store for many, many years. I'm a loyal customer as a matter of fact which adds to my disappointment as to our refusal, and the way you went about it.

I never used the word Moronic. Please do not put words in my mouth.

There is no hell bent destruction of local businesses, to suggest as such is attempting to justify your morally and legal short falls.

I urge you to go to the law, as previously stated I will be perusing this issue in a bid to stamp out your blatant refusal of service to a healthy person with the proper signed exemptions by medical experts. You are thumbing your nose at anti discrimination laws and our constitution that protects us from such behaviour.

I urge you to change your attitude and start taking our constitution and our bio security act seriously, stop discriminating and maybe do some research to understand what a mask actually does and does not do, in particular if you are perusing the law as all these things will come...

DISGUSTING!!!!! LOOK WHAT JUST HAPPENED TO A FRIEND OF MINE..

THIS IS VERY HURTFUL.

A SHOUT-OUT! A disgusting business establishment:

Marina Ice Creamery (Nelson Bay)

Just went into this place to buy my 5 yr old an ice cream. He, as always, wanted a cone, but still does not have the hand skill to hold a cone. I ordered a cup and asked for a cone on top of the ice cream, and said repeatedly and clearly I am HAPPY to pay for the cone.

The request was refused repeatedly by the owner, whose response was "we do not do that here." I explained all the reasons why we needed that, and it was still refused.

Left the shop in shock. Sent my child with my sister away, and returned to Marina Ice Creamery, where the same man (owner) was still standing there. I told him I need to speak with him, and he came over with a smug look on his face and repeated, "I am very sorry that your child has special needs, but that has nothing to do with us." I told him that it has everything to do with him because my special needs child is going to grow up to be a special needs man who they are denying the right to have an ice cream cone.

We proceeded to get into a very heated exchange as his business partner continued to tell me if I wanted a cone for my child I should go down to IGA to get him one. I told him I would have been happy to pay $10 for the cone, to which he replied "you think we would do that? You think we would take $10 for a cone?" Mockingly.

There were so many more disgusting things said, and yes, I walked out of there in hysterical tears, but the bottom line is this:

BOYCOTT Marina Ice Creamery in Nelson Bay. They don't care about catering for children with additional needs. I have never named and shamed, but this one was a shocker.
