Disappointing Uber Eats Order, Melted Ice Cream!
I placed an Uber Eats order from DSpot Markham (A14, 3000 Hwy 7, Markham, ON L3R 6E1), and I was extremely disappointed with what I received. The two “ice creams” looked nothing like ice cream. They were completely melted and resembled milkshakes. I have attached a photo to show exactly what arrived.
While I understand soft serve can melt quickly, DSpot has a responsibility to ensure items are packaged and preserved properly for delivery. Many restaurants take proactive steps such as: • Pre-freezing soft serve to a colder-than-normal temperature • Using insulated or dry ice packaging for temperature-sensitive items • Not listing extremely meltable items if they cannot be delivered intact
This clearly was not done. If DSpot cannot deliver soft serve in proper condition, it should remove the item from their Uber Eats menu. Selling a product that arrives unusable and unrecognizable is misleading and unfair to consumers.

Under Ontario’s Consumer Protection Act, 2002, this situation may fall under: • Section 14 – Misrepresentation: Advertising a product and delivering something materially different (a melted mess instead of ice cream) could be considered a false representation • Section 18 – Unfair Practices: Supplying goods that are not of reasonably acceptable quality may constitute an unfair practice
Action Requested:
I expect DSpot to resolve this matter within 48 hours. This could mean a refund and improved handling of future orders. If this issue is not addressed, I will proceed with filing complaints with the Better Business Bureau (BBB), the Competition Bureau of Canada, and other relevant agencies.

I had a lacklustre, confusing experience here on Saturday. First, there's a "wait to be seated" sign at the door, so we stood there waiting for the staff. We were confused since they were setup like a fast casual restaurant that is self service. After a while, staff waved at us to go up to the counter and seat ourselves...so why the sign? The menu looks enticing, so we ordered a classic funnel cake and a twisted tornado ice cream dessert. The entire process was self service like a fast food chain, except for cleaning up the tables. The chairs at our table were extremely uncomfortable so we wanted to swap tables but there was no staff to clean empty tables so we had to do so ourselves. The funnel cake was good, checks all the boxes you'd expect, but nothing to write home about. The twisted tornado looked cheap and was disgustingly sweet. It had no depth of flavours, reminds you of an oversized mcflurry in a seasonal flavour. I had 4 bites and wanted to toss it out. The price point of this place reminds you of Demetres, which is a sit down establishment with desserts served to you beautifully plated. D spot on the other hand, charges $10-20 pp for fast food quality dessert and service. As the cherry on top, they only allow 18%, 20%, 25% tip on the machine at the counter, appalling if you ask me.
