Malen & Associates PC — Attraction in Town of North Hempstead

Please get this law firm shutdown!!! I just got off the phone with them and they were incredibly rude and shady. First they had no record of me, then they tried to force me to give them my social security number and I said that since they’re suing me they should have my info already and the lady said they don’t and they need it or they would just keep harassing me and calling me 10 plus times a day if I didn’t give it. I told them that their person who tapes the summons to doors tried to open my front door and come in the house and the attorney Andrew Hughs kept laughing at me and telling me I was lying and I’m not. I had to threaten to call the police on him to take me more seriously. I wanted the name and company of the people who attempted to break in my home and he said he wasn’t going to give me that info and to search it online if I cared so much. I tried to explain to him that I wouldn’t be able to pay Capital One the amount I owe because I’ve been unemployed for 2 years now and I have no money coming in and the government won’t give me any benefits so I’m practically living on the street at this point. He said they will continue to ruin my life if I don’t pay but I have no money. I then tried to explain to him that I live 2 hours from the Bronx County Courthouse and that it’s hard for me to get down there to put in my statement with the court and he said that “sounds like a me problem”. I kept asking him to resolve the matter on the phone and he just kept getting nasty with me. I asked him to send me the recording of the call that we had because I would like the court to hear how nasty and unprofessional they do business and he laughed at me again. I was finally able to take these crooks to court to rectify all they have done to destroy my credit and my livelihood. The judge ordered that the judgement they placed against me without my knowledge, I was never given a fair hearing, be vacated and that we settle the account for $2500. I paid Malen the same day, have the transaction to prove it, and they said they received the payment. It’s been over a week and I have yet to receive the court ordered letter from them that confirms the payment was received and that the judgement was vacated. Capital one their client has not updated my credit either and continue to ruin my life. This is all abusive debt collecting practices. The sad thing is when I try to speak to capital one to rectify this they say they can’t talk to me and I have to speak to Malen because they’re the attorney. When I speak to Malen they say they have nothing to do with reporting on my credit and they are just debt collectors. I feel helpless and taken advantage of by these people.

It’s clear I’ve been scammed by these people and capital one. I made my payment, have a court ordered letter to prove it and instead of updating my credit, capital one refuses to do so and “they have the right to take as long as they please to update it.” I have already called all 3 credit bureaus to let them know the situation and they will be expunging these fraudsters off my credit. It’s illegal to not properly update a credit reporting account correctly. I will be suing and pressing charges against everyone involved in this scam!!!! Ok I have not received one statement showing my payments I have made they send me a new threat of filing suit against me only they show what I owe and what I didn't pay so I don't have any idea or receipt of what was originally amnt owed and what I paid . It not legal to not send receipts or statements and they want me to to call to pay each month I was told can't pay by website or thru original debtor capital one. Why wouldn't u have website to make payments or another way besides check by phone or mail. Why don't I get a statement each month w original and current balance w payments ? I have a right to that. They can make up whatever they want.only phone payments which I need to give personal info to them it very. Uncomfortable and scam like. Worst part when I first started w them they put HOLD on my bank accounts .Now I'm no lawyer but from what I understand the only ppl who can do that is government for taxes.
