“ Yes the server was done. She was done because the group of young adults were vaping even though it’s illegal and there are signs everywhere. And one of the men at the other table (your table?) was trying to pass an alcoholic drink to one of the younger adults that did not have his ID. As well as the others at that table with ID’s were also trying to pass alcohol to the others without ID’s. The ID issue was addressed by the server and the manager. As a server when you have customers that continuously try to do things they know are illegal even after you ask them to stop is frustrating. As far as her taking their order after your table, she had tried to take it twice and was asked to come back because they were waiting for a friend. The friend took quite a while to show up. Maybe we all need to Do Better.”
Hello, I am the “younger adult” you’re referring to. While I admit I look very young, I am 28 and was the oldest one at the table. The person who passed the drink to me was not one of the young adults at the table as you say, but was my dad at the other table. There’s two assumptions that objectively false right there - don’t be so quick to defend them.
First off, the owner here is speaking as if there was only an issue after customers caused it. They don’t address the fact that it took somewhere around 45 minutes for them to even take our table’s order. The other table in our party had not only ordered; but was finishing their food when we put ours in. Selectively poor service was apparent before any of the events described by the owner.
On the issue of alcohol, while I realize it is against policy, and it’s understandable that you’d want to prevent underage drinking, there was nothing illegal happening. If you had called the police, in the end, nothing would’ve happened. Because while it’s against policy, it is not illegal. However, the disregard to ensure an allergen was not present in the food of someone with that allergy is against the law.
Vaping in an outdoor dining area is a civil violation under Maine’s Outdoor Dining Law. Disregard for a customer’s request and inability to provide a clear answer about presence of allergens is a much more serious legal issue, covered under both Maine law and the FDA’s Food Allergen Labeling and Consumer Protection Act of 2004.
The most serious failure was not the 21 year old vaping or the 28 year old drinking without ID - it was the adults working at the establishment biased towards relatively insignificant rules and ignorant of far more crucial laws.
My food however was impressive - don’t know how they manage to make something look so good and still taste like nothing. Somewhat of an art, really. Read moreWe have been going to Captain Jacks for 8 years. This year we went with a group of racially diverse young people. We waited an insane amount of time to be seated. We had two different tables. The waitress who served the young diverse table was so bad, they hadn’t even ordered when we had been served our meals. One person at that table had a seafood allergy, which he notified them of. When his meal was served and it was very obviously fried in seafood oil and he questioned it she literally pointed her finger at him saying “I’ve had it with you”. I am horrified at the blatant racism. Do better.
Assuming bad behavior was the issue - why did we stand there waiting for a table while the waitress and manager stood there looking at us and talking? We all sat at the same time. Nobody was waiting for anybody. I bucket handle broke and I spilled most of my drink. (Right after it was served) We cleaned it up. No one came to help. When I had finished cleaning it up said waitress walked by, throwing a dishrag at me. She did not stop. Or say a word. All of this was long before the other table even ordered drinks. The whole time we were there this waitress and manager (you?) were standing there watching that table. You were noticed. As far as the seafood allergy there’s no excuse. He asked multiple times if the same oil was used for the seafood. She never gave him a clear answer. He ordered the chic sandwich because, well, what restaurant would knowingly serve an allergen? Yours. And when he told her he couldn’t eat it after one bite she yelled at him. The appropriate response se would have to comped that meal - at the very least- esp considering we spent over $600. My sister was served a drink that was unsecured (bucket) and it spilled. The server glanced over and went back to looking at her phone, even when I attempted to gain her attention. When I finally was able to “pull her away from her phone”, she threw a towel on the table. We handled the situation ourselves by cleaning up with napkins. No big deal. I realized our party sitting next to us were receiving their meals only when we had consumed ours and were ready to leave. I was also aware that one of our party informed the server that he is allergic to fish & asked that his chicken be made in a different oil. When he received his order it clearly smelled like it was cooked in oil used to fry fish. His server was indifferent to this concern. Our party at that table had to “bag up” their food because the server decided she couldn’t bother to take the order anywhere near when our amazing server took our order. I observed their server to “reprimand” a grown man for vaping, he quickly put it away and apologized. She wagged her finger in front of him and said “this is your last warning” like he was a child. He did not vape before this, so I don’t understand why she’d wag her finger at him like he’s a child (22 yrs old) because he requested his food not be cooked in the same oil that they cook fish in.
