Service dogs and their handlers are commonly mishandled and even mistreated in restaurants. Service is often denied, illegal questions asked and documentation demanded that is, by federal law, unnecessary. The fallout of such an altercation can run into the hundreds of thousands of dollars in penalties, fines and awards to the plaintiff, not to mention the ensuing public relations firestorm on social media.
Most people are under the false impression that only seeing-eye dogs for the blind qualify as service dogs. This is not true. There are many types of service dogs, with many disabilities being invisible to the naked eye. Such dogs can be, just to name a few examples, medical alert dogs (diabetes, epilepsy, peanut allergy), mobility support or psychiatric conditions. Just because a person’s need for their dog is not easily apparent to staff or management does not allow for the patron to be excused.
There is also a pervasive notion that health code pertaining to pet dogs supersedes federal law allowing service dogs full public access. The American Disability Act, as enforced by the Department of Justice, specifically states that all service dogs MUST be allowed into any and all types of businesses and public spaces, whether they are markets, restaurants, dry cleaners or theaters.
If you have reason to doubt the validity of the service dog, there are only two questions you may ask:
Is this a service animal? What task does this animal provide for you?
The courts have been very clear that if a person responds, "Yes, this is my service dog," that the business must take their word for it, and further inquiry is both unjustified and illegal.
Staff or management may not ask, "What is your disability?" This is private, protected information and considered harassment of the disabled. You may not ask for the dog to demonstrate the task it provides. It is also ILLEGAL to ask for "proof" of any kind, including documentation or a vest, as neither the federal or state government requires it. The only entity allowed to decide if an animal is truly a service dog is a judge in a courtroom.
Fortunately for OSB, I am not a vindictive person, so I'm not going to pursue legal action. Needless to say, (after being a loyal patron for 15 years), we'll take our business elsewhere, as we've never had any issue at any of the other local...
Read moreTypical "sports" bar. Plenty of TV's showing several sports channels. Nice interior seating area, and a good sized patio for outdoor dining as well. Adequate beer and liquor selection, but a limited wine offering. Typical menu offerings that you would expect at a "sports" bar. That's about the only good things I have to say about our experience here... We were seated quickly, and our drink orders taken, and then the waiting started... It took 15 minutes to be served a soft drink and a domestic beer. This is while we can see directly to the waitress station where 4 waitress' (including ours) were congregated around someone's cellphone the entire time. Another 30 minutes to get hamburgers and onion rings, and NO, they were not busy. A party of 6, and ourselves inside, and by my count 9 patrons outside scattered at 3 different tables. When the food did arrive, the burgers that were ordered medium well were way beyond well done, dry, and flavorless. The only enjoyable food item were the onion rings. The waitress that was so busy before hand recognized my dissatisfaction with the service became an absolute nuisance coming back to check on us 5 times while we were trying to eat. It just kept getting worse the longer we stayed. I can't recommend this place and we definitely will not...
Read moreI had no attention of actually writing about my experience here, i have been here many many times and loved every time even they’re steak tacos, the last time i went if was completely different my food was swimming in grease and burnt, i have really bad anxiety and didn’t want to say anything, my very KIND waitress noticed i didn’t say much, she very nicely asked me what was wrong my friend helped me speak up and i told her what was wrong she very kindly took my foos back said she will see what she can do, my anxiety was little bit better then the manager came up to yelled at me and accusing me of stuff and in a rude way saying they are two dollars and not to expect much, I didn’t fight paying for them i was planning to anyway, she made me so upset i full on had panic attack and waitress was very nice and got me water, i saw review same as my experience and I commented i had to the same experience and told them the same story as above then the manager accused on here of being a liar and trying to destroy her thats not my attention, I planned on coming back one day but no I won’t...
