Staff need to be made aware that even though the conditions of entry sign does indeed allow big w to require bag checks as a condition of entry, the legal position of the NRA ( National Retail Association) is that Bag checks are voluntary, and may only be conducted with the consent of the customer. A person who forcibly conducts a bag check against a customer’s will may be liable for assault.
Staff should also be instructed to be polite when asking to check a bag. Not " I need to check your bag!" but "May I check your bag?"
I would not have made this a public review but it appears that Big W no longer accept feedback via e-mail.
I was personally very offended by the implication that I had stolen from this store.
Futher also from the NRA: A shopper can refuse to allow a bag check. In that situation, a shopkeeper may ask the shopper to leave the store and not return unless he or she is prepared to comply with the store’s conditions of entry. In doing so, the shopkeeper is terminating the licence agreement. A shopkeeper or employee who forcibly searches a bag against a customer’s will may be liable for assault. A shopper who has been forcibly detained by a shopkeeper may sue for false imprisonment if they have not committed an offence. You must therefore be absolutely certain that an offence has been committed by the shopper before you forcibly detain or search...
Read moreMy partner and I went to do last minute Christmas shopping at TTP and split up. Before heading home I realised I needed something from Big W, and my partner came with me despite having already done their shopping at Big W earlier. They were holding a Big W bag from when they went in earlier and went to leave through the store entrance while I went to pay.
My partner is neurodivergent and wears noise cancelling headphones. As they were walking out security called out for them to stop to check their bags, but they didn’t hear them until they were called repeatedly because of the headphones.
The security person was immediately hostile to my partner, and when they couldn’t produce a receipt (because they opted not to print one at the kiosk) didn’t give them a chance to explain before taking their items off of them by force. My partner is trans and was repeatedly misgendered by this staff member while they tried to explain themselves. They were eventually able to leave after showing the staff member the earlier transaction in their bank app.
It is completely unacceptable to treat somebody this way, especially someone who is cooperating and not trying to run or anything. My partner is clearly neurodivergent, yet this staff member chose to treat them like a criminal from the get go when they did nothing wrong. I get they were doing their job, but...
