I’m writing this review from my recent experience with Spencer Daunno as a landlord. I will say that most of the time I was there I didn’t have a negative experience except for waiting weeks to hear back from him sometimes when I would inform him of any minor issues that came up with the unit. This review is in response to the unlawful deduction from my security deposit when he showed his true colors. I tried to have a civil and respectful discussion via text when I was told that I was being charged for replacing blinds that I did not damage. I also have video evidence of the unit/blinds in question the day I officially moved out. I also have screenshots of conversations with Spencer informing him of one of the blinds in the bedroom not working months prior to moving out of the unit which was never replaced. In addition, Spencer also replaced the blinds after I moved into the unit due to the previous tenant leaving holes and leaving them visibly dirty. There was an issue with one of the new blinds in the living room that stopped working and he kindly replaced it again. And now he tells me that I left them for him to replace and that I should have replaced them? I patiently waited months after telling him in February and also tried reminding him a few times about the blinds and he eventually came to look at them and I still had to follow up with him and he said they don’t work and would need to be replaced. He never once said “you need to replace them.” It’s clearly an issue with the brand of blinds being purchased. I normally don’t file complaints in general, but felt that I was spoken to with disrespect after being a respectful tenant and taking excellent care of the unit. I also did not receive any itemized statement for the deductions or proof of damage which is required by NJ law. There also is nothing stated in our lease that I would be responsible for paying for anything that malfunctioned out of my control. This is considered normal wear and tear. This also isn’t about the money. This is about my rights as a tenant, common decency, and following New Jersey law. And since he told me that I “don’t understand how this all works” I have done additional research on the following. In New Jersey, landlords are permitted to deduct from a tenant’s security deposit for damages that EXCEED normal wear and tear. However, they cannot withhold funds for issues that arise from ordinary use or the natural aging of the property. If a set of blinds in a rental unit stopped working due to regular use or aging, this would typically be considered normal wear and tear, and the landlord should not deduct the replacement cost from a security deposit. Given that I informed him about the malfunctioning blinds four months before my lease ended, and there was no misuse or negligence on my part, any deduction for their replacement is unjustified. As such, I believe this deduction is unwarranted and constitutes a wrongful withholding under New Jersey law.
