Please help Utica national insurance has been voiding payment for our family vehicle for 80 days (update 132 days and counting) We are a working class family in a desperate point We really need our family vehicle back
looking for any legal advice or advice on what to do next , they accepted to by at fault and our family vehicle cost only $5700 and they decided that is a total lost and that 1 day will be paid, but for 80 days and counting they have been doing paperwork and as todayās call they said they still doing some more paperwork, We have been calling them sending emails always similar answers , like the guy who is in charge of your case left early today or just any excuse or hang the phone on us , this situation is super stressful for as to donāt have our vehicle, for a family of 5 my husband and me work full time , our oldest son is a full time college student and has a part time job our 2 younger kids attend schools at a different hours , We do have another vehicle but for an active family of 5 it is just impossible to schedule everything with 1 vehicle , We have been using our hard earned money savings paying for rides for the past 80 days but our savings are draining ( if We knew that theirs paperwork processing takes longer than 80 days since the beginning We would use our savings to buy another vehicle but at this point that is not an option We already spent it paying for rides
Please advise on what can We do
At this point can We sue them or the owner of the business that hit and destroyed our vehicle for them to pay for our vehicle ? I giving further description of the facts below

Our original estimate was $113K from a large water loss (cat 3/toilet water) they came back and said they would give us $47K. This amount was from a desk adjuster in NY and we are in VA! My estimate was from a Class A Contractor. We fought with them for almost a full year. I got several more estimate that cost us additional money out of our pockets ($200-$500 each). The lowest we got was $97K. They denied them all. Finally they agreed to send a class A contractor on their ends to do an estimate and they came back with $87K. Still not enough. We couldnāt even leave our home even though we had ALE (additional living expense) because we couldnāt lock in a contractor and get a repair schedule to turn into the adjuster. We asked multiple times for them to home us elsewhere until the repairs were complete and the response we got was āwe will home you once we get a schedule when repairs startā. After a long year and holidays coming up we decided to accept the $87K. My kids cried for their rooms back and normalcy. I was ready to fight and keep at it but I could see the toll all this had taken on my family. They ended up dropping us in the midst of the claim! Trust me we were not sad. I was told I was.bejng charged $250 for the current month and $250 for the upcoming month. I told the representative I would only pay for what I actually owe, $250. Upon completing the payment I received a notice from my bank that Utica National was processing a payment for $250 and required my authorization. I authorized the payment. When I checked my account balance I discovered Utica has debited my account $500. When I called back the initial attitude was "well the amount due was $500 and you paid $500 so what's the problem?" When I finally got someone to listen me. They apologized for the error and said they would "amend" the payment to $250. The following business day the $500. was still "pending" in my account. I received an email from their billing department that explained the payment had been cancelled altogether and I still owe them $250 since the payment had been cancelled. I was livid. I called Utica and they placed the blame for the "delay in processing" squarely on the shoulders of my back. They said it would take my bank 24-48 hours to "process the cancelled payment." Today, 48 hours later, I checked the account and guess what? That $500 "cancelled payment" is still "processing." and a add insult to injury a scheduled electronic payment that was scheduled was returned for insufficient funds!!!! The matter is...
