You have rights as a consumer under the Consumer Fraud Act. The sales order you signed is not valid or enforceable according to NJ law that protects your rights as a consumer. It does not matter if your sales order says Special Order, No Refunds, No Cancellations, All Sales Final or Store Credit Only. - this is illegal.
Eddie R./Bilal A./James Marstiller/Betty Jones at Furniture & Mattress Gallery/Furniture & Mattress Outlet/My Furniture Galaxy/whatever they are deciding to call the furniture store inside of Unique/MyUnique Thrift today, are engaging in deceptive and fraudulent business practices.
According to New Jersey Administrative Code Title 13 Chapter 45A Subchapter 5.1 (NJ Admin Code 13:45A-5.1-4), your purchase order/receipt/invoice MUST state a promised delivery date and they MUST deliver your furniture on or before the promised delivery date. If unable to do so, they MUST provide written notice to you notifying you of their inability to meet the delivery date and offer you the option of a FULL AND PROMPT REFUND. Failure to do so is a deceptive practice under the Consumer Fraud Act.
Supply issues DO NOT waive your rights.
The sales order you signed IS NOT VALID. It MUST state the following:
It is ILLEGAL for them to put "all sales final," "no cancellations" or "no refunds," on the sales order. If your sales order says any of this, it is NULL and VOID and UNENFORCEABLE.
IT DOES NOT MATTER IF YOU SIGNED IT, New Jersey Statute 56:12-15 (N.J. Stat. Ann. § 56:12-15) prohibits consumer documents from waiving a consumer's rights.

Read moreThe worst store ever. I purchased a bedroom set and a bar from them in August. It was a sleigh bed. It was beautiful. The day it was due to arrive I received a phone call; after the delivery time to tell me some of the pieces were broken. I took off the day from work because they were not able to deliver within the 2 days due to covid. This I understood but they waited until after 12 pm to notify of the parts. I was going to cancel because Eddie the sales guy was very rude. I went to store and Kalel I think his name was convinced me it would be alright. They reset delivery date for a Friday. On the Wednesday as I was leaving work I was given a call they were there. Irritated I was going to tell them never mind. They already had the furniture unloaded when I arrived so I accepted the items. Set up went easy except the bar I ordered was not completely tightened..small problem. Well less than a month later the bed is broken. I had to move it because I spilled something on the floor and needed to move to clean. Fast forward four weeks. The bed started squeaking and sinking in the middle. I again moved my bed and to my horror the stilks on the bottom were all sideways and two were broken. Took pictures and called store. This Eddie guy answered and told me because I moved the bed the legs broke and it was my fault. Well I explained no one ever said it could not be moved. I would NEVER had purchased if that was the case. Well its now been almost another month. No answer from store as to a date but an email that say I should not be sleeping on the bed. This is know because I am not going to fall through it. The email keeps saying go into the store but Eddie said NEVER call the store or come in. He is very INTIMIDATING. WOMEN ALWAYS BRING A MAN!! Now I am out over a thousand dollars and sleeping on my couch to boot. I am now in the process of taking them to court. I will show pictures on my next post. Read moreBought a sectional sofa in July 2017. When they deliver the chase is damage so they have to get that part fix and deliver another day. After a few months I notice the armrest is soft and the chase is already sagging. Feb 2019 my daughter leaned on one of the seat and the backrest broke. When I went to the store to complaint they said that they cannot do anything because we bought more than 2 yrs already. I told them that as I understand it is not yet 2 years as 2 years means 24 months. it is only 19 months. When I showed the manager “Eddie” the picture of the sofa he right away said that we abused the couch to which I said how can we abuse it if we don’t use it that much and only 3 adults live in the house. He was rude and said that I was yelling we I was only trying to explain to him that my side. The couch cost more that $1700 and in less than 2 years it is already damage. I bought couch for other store than is now more than 7 years and they still are in good condition. Beware of this store!

I have been emailing your company and your company told me to contact the manufacturer. When I contact the manufacturer they said to contact you again and your company are the one who is going to contact them. When I contact you again your company said that you will contact me again and send somebody to check the damage and see what you can do. After that I have not heard from you and even my emails have been ignored. I don’t think the couch was a good quality. In fact in less than a year there is already signs of sagging. For $1750 I expect good product and that even without the additional warranty it will last more than 3 years! I have furniture and sofa’s that cost less, older that what I purchase from your company and is still in very good condition. We don’t use the couch that much. I am already wondering that the couch might have been broken in less than a year if we have been using...
