My dining experience was marred by unprofessional conduct from our server. My food was inappropriately touched by server which raised serious health and safety concerns. Also the server tapped on my shoulder which is an inappropriate physical contact and violation against customer .This incident points to a larger problem with customer service standards and staff training at this restaurant. In detail my brother and I both ordered fish and chips .His plate was fine but in my plate one piece out of three pieces was not good .First thing it was all batter and had literally no fish .Aside from that the thin slice of fish inside that piece was not fresh as the other two I had consumed and I was afraid to get food poisoning because I'm a medical student and I have a final exam coming up . So I called the server and politely asked him if he could replace only that one piece for me because one piece not being good out of three is not reasonable to ignore. If it was one out of 5 I could ignore to avoid nervous conversation in restaurant. First thing he touched my food with bare hands although I wanted to consume the fries and slaw in my plate and I had not asked to replace the entire dish .After that he tapped on my shoulder which was an inappropriate physical contact and told me he has to discuss it with his manager .Then he returned and told me he can bring only one piece and not the entire dish.From the beginning I asked him to replace only that one piece that was not good and not the entire plate .In fact he treated me with suspicion as if I wanted to get another entire dish .Even if server gets suspicious that customer wants take disadvantage although this was not true in my situation since I only asked to replace that single piece that did not seem fresh , he still did not have any rights to touch my food which has a serious safety concern and continuously tap on my shoulder which was very uncomfortable and unpleasant for me.In fact i think the reason behind his behavior was that we did not order any drink at the beginning when he asked us about the drinks and I could tell he got upset after we asked only for water .Since I'm studying for a big exam I'm not in a situation to enjoy drinks at this time .Indeed I have dietary restrictions and can not use sodas and even diet sodas because they rise my blood sugar and create digestive issues for me respectively.I'm pretty much confident and I could tell from his reaction that he got guard against us from the beginning after we did not order any drink and went straight to order main food and his inappropriate and unreasonable suspicion and violations toward me was a actually a revenge . If a customer is mindful about what he or she wants to eat and does not order drinks or high calorie appetizers it does not mean they're in shortage or want to get something out of restaurants . I informed the restaurant manager upon leaving about what had happened for a simple request of replacing one piece of fish ! What he did created significant emotional distress for me and I could not sleep all night and woke up with heart racing 3 times. WHEREAS, In between cooking up overpriced fish dishes, Bob Mardian found the time to spread his culinary "genius" to other locations, because apparently, one overrated restaurant just wasn't enough for him; and
WHEREAS, Despite serving up dishes that would make even a seagull cringe, Wind & Sea Restaurant somehow convinced people to hold their weddings and special events there, probably because they were too drunk on mai tais to know any better; and
WHEREAS, Wind & Sea Restaurant proudly boasts a staff so ancient that their uniforms might as well be labeled "antique," with employees so deeply entrenched that their family trees are basically part of the restaurant's decor; and
WHEREAS, By joining the Dana Point Chamber of Commerce & Visitors Center, Wind & Sea Restaurant secured itself a shiny award for pretending to care about the local community while raking in profits from overpriced meals; now, therefore, be it
RESOLVED BY SENATOR NORMAN BATES, That upon the celebration of its fiftieth anniversary, Wind & Sea Restaurant be sarcastically applauded for somehow convincing people to eat there for fifty years and for pretending to be a pillar of the community.

They told us it's self-seating but as we were looking for a place to sit we found out a waitress was following us around without telling us, and then telling us we can't sit at any of the places we were picking. Why? Because "it's reserved seating". But it was just an hour before closing, plenty of tables available, and if anyone still had a reservation and was really going to show up (which I doubted) they could have had any one of those available tables. Since when do they set aside a bunch of tables for reservations that haven't even been made yet and force the diners who are already there to take lesser tables? (By the way, nobody else showed up so that was a lie). The tables are packed too tightly, and it was hard to even get into our seat. There were was a restless kid in the chair behind me with her chair backed up to mine with nowhere to go and it made it unpleasant. What are you going to do, tell the kid to stop and risk an argument as soon as you arrive? Fortunately they left before our food came. Ordered the "wild caught shrimp". Was such a dissapointment. Maybe around 6 small/medium size shrimps which had no taste. The veggies were just steamed with no taste. Both shrimp and veggies were almost cold. The portion size was small. 6 small /medium shrimps is a joke for an overpriced dish so I had to eat some of my husband's food. He had fish & chips. It was mediocre with little taste. Too much batter and not much fish. Had a lava flow cocktail which was just ok, maybe below average. Ended up paying over $80 for dinner for two and 1 cocktail.
