Showed up here for a friends’ going away party. Within minutes of sitting down a shorter long-haired waiter came up to ask for IDs. My fiancé had his (30 years old) and I realized I forgot mine (27) I’m a new mom and normally don’t leave the house without it but I had gotten a new wallet that week. This was also our first night out without our baby so it was kind of a big deal for us. I had photos of my valid ID as well as my passport, OR I could’ve simply NOT ordered any alcoholic drinks for the night, but instead the waiter promptly and very rudely kicked us out. The kicker for me was how he tried to humiliate me in front of our large group of over 15 people with the comments he was making as I was explaining the situation. Felt totally unnecessary.

We were chuckling until we realized the bartender was being serious. Perplexed, we left just minutes after we arrived and took the birthday boy to another bar close by and told them what happened. The bartender there seemed shocked because we all were completely sober. Maybe the bartender at Starduster didn’t like that we were celebrating a birthday and we were laughing and having a good time? Probably won’t be...

He scanned our ID’s and refused to delete when asked. When I raised this, I was told, “we don’t do anything with it.” But retention itself is illegal, the only compliant action is to delete it. Customers should know they have the legal right to request deletion.
Under Texas Alcoholic Beverage Code § 109.61, bars may scan IDs solely to verify age. They are not permitted to retain that information unless required by TABC, and for on-premises alcohol sales, no such retention is required. The statute explicitly states that retaining such information is prohibited and that violations are Class A misdemeanors. Other bars have had no...
