1st Court Appearance - Misdemeanor So what happens at your first misdemeanor court appearance in California? That first appearance is called an arraignment. An Arraignment is the first Formal Court Hearing where you are Advised of Your Rights to an attorney, right to a jury trial, right to subpoena witnesses, right to cross examine witnesses, you are informed of your charges, you get what is called a Complaint which are your charges. #misdemeanor #criminaldefenselawyer #court #hearing #california #oc #fullerton #santaana #ie #sanbernardino #riverside #judge You are asked to enter a plea Guilty or Not Guilty. Depending on the charge the Judge will set bail. What doesn’t happen: You don’t get to argue your case Charges, they will not be dismissed. A lot happens at this first appearance. If you have a lawyer, they will do the talking so you dont have to.

I filed a small claim as a plaintiff regarding a car accident that occurred on March 08, 2019, I was rear ended by defendant's traffic violation not keeping a safe distance so called tailgating

Original trial date was set on October 01, 2019 but it was postponed due to so many people in mediation session that would never ended in a day although we waited more than 4 hours just to talk to a mediator but commissioner ordered us to appear back the next week which was October 08, 2019

Both parties appeared and stood before the commissioner and began to argue from both parties and there was a reason for me to believe that the defendant was not telling the truth about the accident so during my argument I mentioned “she lied to the insurance company to avoid her liability” and all of sudden commissioner Glenn Mondo moved his body toward my side of stand and said “I believe nobody is telling the truth in this court and everybody is saying the other party is lying and I don’t want to hear you saying “she lied” and if you say that word one more time I will dismiss this case right now and you will never be able to recover your loss!!!” (his actual comment was longer and more explicit, intimidating than this)

Glenn mondo was showing his uncomfortable behavior toward my argument and after he mentioned it, he became very reluctant to accept my exhibits so I had to show my exhibits by holding it with my hands from a distance and at the end of argument sheriff officer collected my exhibits and handed to a Mondo's desk.

This trial was very frightening and intimidating due to commissioner’s misconduct violating my right to use the words that are necessary in order to explain what happened during the trial.

His misbehavior clearly implied the notion that he will judge the case in favor of defendant and sure enough he reached the verdict in favor of defendant.

In addition to this incident, defendant brought absolutely nothing but few words to defend her side of the story whereas I brought and submitted enough evidence to prove my case such as photo of accident, police report, letter from the insurance company, diagram of accident and receipt of my payments for vehicle repair and doctor’s bill and still lost the case.

What is worse is that there is no explanation why the commissioner reached his conclusion on judgement letter, not a single comment…...so I went to the court and asked the clerk is there any way that I can hear from anybody regarding this judgement and they said “I don’t know and unfortunately that is normally how it works without an explanation of judgement, sorry”

This judicial system gives too much power to a judge or commissioner that enables for them to say and judge whatever they want to regardless of evidence and facts based on the actual events and eventually it leads to corruption and our citizens will and being suffered from it.

If you are a plaintiff or defendant and presenting an argument to win the case and the judge sitting in front of you becomes bias based on the words you say or your behavior, not the evidence you provide, you get frightened, intimidated and threatened and that is what exactly happened at my trial.

I still want to hear the explanation based on what factors were influenced or affected to this conclusion from anyone at the court and that way, I can at least understand how this judgement was reached this...

On July 12,2024 I went to the Court Clerk window and gave one clerk and asked him to filed them and he asked me if I needed copies of them, I said no, because they were lots of pages including my wounded injuries pictures on head and other parts of my body in colour, I asked him politely to give me a receipt, he said we didn’t have receipt form, but I stamp one of the pages in your documents and stamped the first page that was issued by Santa Ana CJC to Reassign my Case to Out Of County Judge in San Bernardino Superior Court- The Rancho Cucamonga District Court. I thanked him and asked how soon I would receive the Hearing and Trial Dates. He said in two weeks. I didn’t hear from the court for about a month so I drove from home In Costa Mesa about an hour and a half to ask about the court dates. When I told the clerk about my filed documents, she denied and said that you never filed any documents with us! While smiling! I became surprised and sad. I should her the Stamp with Logo and name and address of the court. I asked for their supervisor, she came and promised to find my documents. After a week they called me and said we could not find your documents. In my case I made a lawsuit against one of the Honorable Judges in CJC in Santa Ana with strong obvious partiality and bias in my case!! I need to mention that I made “ A long Report “ about either lost or destroyed or what could be happened to my essential documents for...

Another example of the failed justice system. First, I tried calling them to obtain records. After 4 tries, I was still unable to talk to a real live person. Their "call center" is just a series of "informative" scripts; don't be surprised when the information that you are looking for isn't there. To fulfill the asinine obligations that the court had non-nonchalantly bestowed me with, I had to drive all the way to the North courthouse (I live in South County, and to this day no one knows why my case was not assigned to any of the 4 closer courthouses) and wait in line with all of the other shmucks that fell out of line. Most of the people that end up in this messy tangle of bureaucracy are not criminals, but normal people that got caught committing "non-violent" crimes. None of the gate-keepers actually want to help you; in their eyes, you're just a lousy criminal. The individuals that work at this establishment simply collect exorbitant checks, and hand out relentless penalties in return. Don't expect justice here; expect...
