Rent-A-Center Corporate Office 5501 Headquarters Drive Plano, TX 75024 Dear Sir/Madam, I am writing to formally bring to your attention a breach of contract issue that I have encountered with your store regarding my rental agreemen) for the AMANA 3.5 CF HE Top Load 8 Cycles, White appliance. Despite my repeated requests to speak with the manager or a superior, I have not received a satisfactory response or resolution to my concerns.
However, I have been informed by your store that there is a $5.00 late fee, and I am being required to make an almost three-week payment for being late. Additionally, when I called, I was told that the $5.00 fee is added daily, which was not disclosed in the agreement. This requirement is not listed in my contract, and I am therefore not obligated to make an extended payment if I am late. This practice is in violation of the Truth in Lending Act (TILA), as it constitutes an undisclosed and unauthorized change to the terms of my agreement. The relevant section of my agreement states: "If you fail to make a timely periodic payment, you shall have the right to reinstate this agreement without losing any rights or options previously acquired. You may reinstate this agreement if one (1) but not more than three (3) periodic payments are missed and you have surrendered the item to us, if requested by us, during the time in which payments are missed. A reinstatement fee equal to the outstanding balance of any missed payment(s) plus a $5.00 charge per missed payment is assessed; however, you shall not be charged more than one reinstatement fee per missed periodic payment. On reinstatement, we shall provide you with the same merchandise or substitute merchandise of comparable quality and condition." As you can see, there is no provision in my contract that mandates an extended payment for late payments or a $5.00 daily fee. Therefore, the additional charges being imposed on me are not valid and are in breach of our agreement. Furthermore, I request that my payments be adjusted to accurately reflect the number of payments I have made to date, without the imposition of unauthorized fees. In addition, as a business operating in both Texas and Georgia, Rent-A-Center is subject to the consumer protection laws of both states. Under the Texas Deceptive Trade Practices Act (DTPA), Texas Business & Commerce Code § 17.46(b)(24), any false, misleading, or deceptive acts or practices in the conduct of trade or commerce are prohibited. Similarly, the Georgia Fair Business Practices Act (FBPA), Georgia Code § 10-1-393, prohibits unfair or deceptive acts or practices in the marketplace. Your actions in imposing unauthorized fees and altering the terms of the contract without proper disclosure or consent violate these statutes and constitute a breach of duty to your consumers. If this matter is not resolved promptly by removing any unauthorized fees, ensuring that my payment terms are adhered to as outlined in my contract, and adjusting my payments to reflect the actual number of payments made, I will have no choice but to pursue legal action. This will include seeking remedies under the Truth in Lending Act, the Texas Deceptive Trade Practices Act, and the Georgia Fair Business Practices Act to enforce my rights and seek appropriate damages. Read moreI find it very funny how your phone can be blown up when your payment is due the day of. But when you have a scheduled delivery and you have to keep calling to see when it will be delivered. Due to the weather I was very understanding but on the last call I made to the store they stated I was still on for delivery. It’s now 6:25pm and no one called to reschedule which I’m guessing it will be tomorrow but no one called to schedule which will be a inconvenience because I have a whole schedule tomorrow and to arrange for them to deliver will be last minute. I think that very unprofessional and inconsiderate. If I haven’t cleared my son room out I would cancel the order and never do business again with Rent-A-Center. So my son will now have to sleep on the sofa and that’s so unfair. Disappointing a child is by far a disgrace and I don’t appreciate it at all. Even when they get to busy and don't believe my message. The situation always gets handled. This is a rent to own store. They all some what operate the same. So you can get mad because you behind and write a bad review and threaten to go to another rent to own store. But it's best to work it out and pay on your item. If I knew I was gonna be late I called them. So no one would be knocking at my door. When there was a problem with my washer, they sent someone to fix it, ASAP. Like I said, no one's perfect.
