Still never responded to the court judgement against them for selling damaged furniture. Rude and arrogant owner (Victor)
3 years later and the owners still REFUSE TO COMPLY WITH COURT JUDGEMENT TO REFUND US FOR DAMAGED FURNITURE THEY REFUSED TO REPLACE.
Still, after a year and a half, REFUSING TO COMPLY WITH COURT JUDGEMENTE to refund us for damaged furniture they sold us and wouldn't exchange.
This store and its owners continue (as of today Jan 12/2021) to refuse to refund us per the judgement. Over a year now. You should really look up their other legal issues. Seem to think they can just laugh in the face of a judgement as they have done this before.
UPDATE Jan 2020 A judge ruled in our favor and THE STORE WAS ORDERED TO REFUND US and take back the furniture in question. It has been a month since the court date, and the store has REFUSED TO COMPLY WITH THE JUDGEâS ORDER. They have not filed an appeal, and as of today they lost the rights to get the furniture back, per the Judgeâs order. So, there is no reason for them to have not satisfied the Judgement at this point, and likely do not intend to. Based on my conversation with the owner (recorded) it is clear he has no intention of ever paying. (âIâll get to it when I can.â âYou can send me an billing request monthlyâ)
According to Court records online, the owners Victor and Lucy Ramirez have done this before.
Quick recap. We were a repeat customer of Lucy Furniture. We bought a dining server that was delivered heavily damaged. They refused to exchange it. Their excuse? They thought we somehow caused some of the damage (just the light scratches on the top) and therefore they couldnât take it back. We notified them in less than 2 hours after delivery of the damages. And the damages are clearly from assembly or transport. This is how they treat a repeat customer.
We spent several months (May-Oct 2019) trying to resolve this issue directly with the store and its owners, Victor and Lucia (Lucy) Ramirez. All we wanted was to exchange the furniture for one that was not damaged. However, were forced to take them to court. The pictures below show the extent of the defects. When the Judge saw these pictures, he asked the storeâs owner if they thought it was acceptable, because he did not. Even the storeâs owner said he did not find them acceptable. It took the judge all of 30 minutes to rule in our favor.
Update: We confirmed this store is operating FRAUDULENTLY. We confirmed with the manufacturer that the owner is being dishonest regarding the resolution options they have provided him. They have gone as far asking the owner to provide us the email communications between them and the store. The owner is now no longer responding to either us or the manufacturer.
Avoid this store! Our experience with the store and itâs owner was completely unacceptable. This despite us being repeat customers! The storeâs owner, Victor, believes buying brand new furniture is like buying a pre-owned home, and the buyer should expect the item to need some reconditioning. (Per his own words via email). Within 2 hours of delivery of a dining server, we notified Victor of defects. This included deep scratches to inside panels, clearly from assembly. Despite the manufacturerâs 90-day warranty, Victor is unwilling to replace the item. He believes we caused the damage (in 2 hours, even though we left immediately after delivery), and that he is only authorized to provide a ârepairâ. From what I understand, this involves using a marker to fill in the color of these deep scratches on our brand-new piece of furniture. Because of course we should expect a brand-new piece of furniture to have some defects according to Victor. They pretty much took our cash and ran, left us with a defected furniture! đ¤ So frustrating to have to deal with such an unprofessional, accusatory, dishonest, unethical, unreasonable business. Victor and Lucy delivered us a defected/ demaged dining server (not brand new) 2 times later in which Victor refuses to replace or refund us, "Breach of Contract". Not only are there a bunch of deep scratches, misaligned door, there are deep gauges inside. Seemed like demages done with some kind of knife. Not repairable. Ultimately, we paid for a brand new furniture, not a used or refurbished one. My husband and I have been extremely patient and have made several attempts via emails and phone calls the past 7 weeks to resolve the ussue, but Victor simply just does not care! We were finally able to speak to Homeelegance and found out Victor is not honest with the 3 options Homeelegance had authorized for us. Victor HAS BEEN LYING TO US all this time! He only gave us 1 option prior to us finding out, which is to repair it. He has repeatedly told us that this is the only option Homeelegance is authorizing because of their warrenty, which of course WERE ALL LIES! Even Homeelegance is willing to help us, but Victor will not! Homeelegance was not happy with his lies either. He has been refusing to forward the original emails from Homeelegance in which they had requested several times and then instead made up his own 3 ridiculous options that's not even reasonable. I have noticed Victor tries his best to make this as hard as possible for us instead of just simply resolving the issue ethically and professionally. He keeps resisting! I still cannot believe why he would treat us so poorly. We have already spent thousands, paying cash with all our purchases. Victor simply just DOES NOT CARE about his customers! đĄ Extremely unprofessional, accusatory, unethical, dishonest, shady, unkind owners to say the least. He does not keep his words either, especially when he verbally told me demaged furniture can be sent back to manufacturers, in which he now refuses! I will give them negative stars if I can. We have honestly tried to be patient and have given him many opportunities to resolve it without legal actions, but he kept pushing us to take him to court!!! Life is short and I honestly rather spend time with my family then this nonsense! We are honest, respectful, nice, gracious people that have never had any problems with any furniture stores. NFM has been phenomenal and provides excellent customer service. Lesson learned the hard way. Never pay CASH with any furniture purchases! We had visited many furniture stores over time and hadn't found anything that would meet our needs and budget. First when we came across this website, we weren't so sure so we visited them at their physical address, which is a very small place. However their customer service was great and we were able to order from their catalogs (with their different vendors). Their prices are highly competitive and delivery was so prompt and quick! We received all our furniture within 3 days after we placed the order. Exceptional turn around time for delivery. Everything turned up as we expected (no damaged furniture, etc). We did experience some slight issues with 2 pieces of furniture, which was not due to the furniture but because of the delivery guys who set it up. We reported this to Lucy Furniture and the owners themselves (husband & wife) came out to our place in a couple of days over a weekend to take a look at the issues and helped fix them.
