We were in the area because our son was playing in a basketball tournament at Cherry Creek HS. After the game, we walked in the door at 8:02 pm. The cashier warned us that the "manager" had instructed her that the lobby was closed to dine-in even though they don't close until 9:00 pm. We mentioned that we had checked the closing time before we came in and she agreed with us that they should still be open. Meanwhile, another couple walked in and got in line behind us. She proceeded to take our order, then gave us a table number and the plastic reusable, washable cups for drinks - NOT to go cups. The soda machine had been turned off, so we could not get ice or drinks. We sat at a table that had clearly not been cleaned (there were french fries sitting between the slats of the bench seat) and waited for our food. While we sat at the table, the couple that had been in line behind us were "successfully" turned away and left without ordering.
15 minutes later at 8:17 pm, a kid that had been in the kitchen, with a bar piercing on his upper cheek, came out to tell us that we couldn't eat there and we'd have to take our food to go. We argued that they were advertised to be open until 9:00 pm and we would like to eat our food at a table instead of in the car on a 45 min ride back to our neck of the woods, literally as our food was coming out of the kitchen and already being packaged to go without our agreement. We said we'd eat quickly and be gone before 8:30. He became belligerent, so we asked for a refund which he was overly happy to agree to, asked another kid from the kitchen to come out and process a refund on the cash register and refusing to give us our food. My husband argued that the food was already cooked and again asked for the food, and again the piercing kid refused, telling us that they would just throw the food away instead.
As the other kid and apparently the "manager" on duty, Tarique, worked at the register, the piercing kid informed us he had the right to refuse service to anyone and he was refusing service to us. Again, we brought up the fact that the closing time listed on the front door, on the website, and on Yelp all state 9:00 pm, to which he responded that he ALWAYS closes the lobby at 8:30. I looked at my watch and it was 8:21, to which he replied he ALWAYS closes the lobby at 8:15.
Meanwhile, the entire time, the cashier that initially took our order and another female employee cowered off to the side. I looked to her and asked her to please give us our food and we would leave. She declined saying that she couldn't afford to lose her job but tried to hand me a $10 gift card to make up for it.
By the time the entire exchange was over, we were back outside to our car before 8:30 pm, foodless, starving, and seething. I don't know who owns this location, or how this kind of service is acceptable, but I will be contacting not only the general manager of this location, but the corporate office to relay our experience.
By the way, after we left Smashburger, we drove to Five Guys at S. Parker Rd and Havana. They close at 10:00 pm. We walked in at 8:45, placed an order, sat down to eat in the lobby, ate, and left by 9:04 pm. Both the kid at the register, and the gal in the kitchen were very pleasant, even...

The sizes are an absolute joke, and a slap to the face!! I came here with the wife for our usuals, and of course we find out they're gone. I moved to this area a couple of months ago and I was so sad bc this location was the closest to me and the burgers were soooop salty and it was just a mess in there so after two visits I never went back. I used to eat smash burger like once or twice a week. Anyway I finally went back and the new staff is great! I went yesterday 12/5 right before closing and the lady that worked the register was theeeee best! She was so sweet! I wish I knew her name and then there were two younger guys cooking and they were sooo cool to and the food was a1! Keep this staff!
