I contacted Pinto Gallery on 21.12.21 concerning a Takashi Murakami print ("And Then x6 (Red Dots: The Superflat Method), 2016"), which I was interested in. I asked about the condition of the artwork and whether it's still in its original Kaikai Kiki Gallery Box and unopened. I received a friendly response rather quickly that the print "will be shipped in the original flat packaging unframed in 100% brand new condition". Finally, on January 4th 2022, I placed the order after a quick period of price negotiations. A couple of hours later I was approached by the Gallery via e-mail telling me that they realized that the piece they had offered and sold (to me) at Artsy is different than what they have in stock. Instead of "And Then x6 (Red Dots: The Superflat Method), 2016" they have "And Then x6 (Red Dots: Superflat Method), 2013)". Although the difference in the artworks is not that big, it's a completely different series and year. They asked me if I want to proceed with them sending me the other artwork, so not the one I actually bought and which is stated in my deed of sale. Shortly after that first e-mail the contacted me again apologizing for the confusion and telling me that they had reached out to a partner gallery and that they could source the print I actually bought for me, but that it will take about a month to ship to me. So I could decide: get the one I originally bought, which is in my deed of sale and that will be shipped in about a month or the "alternative", which could be shipped straight away. I responded that I expect what I bought and what's in my contract and that I cannot comprehend why any shipping nowadays should take longer than 5-7 days which was stated during checkout. Furthermore, I added that I will contact Artsy straight away and let them know that there seems to be an issue with my purchase. I also asked them to comment on my response, including the shipping period of one month, which seemed a bit peculiar to me. After that Pinto Gallery directly contacted Artsy cancelling the order without any further comment to me but regretting and apologizing for the inconvenience. In the e-mail to Artsy they didn't say anything about the two artworks and that they in fact offered a print they don't possess but said that "Per the conversation with the collector, we would like to cancel order ... as the piece will take 3-4 weeks to ship which does not meet the collector's expectations" and asked for a refund for me.
I don't want to say that all of this was by intention but in the world of selling artworks online, where everyone is always afraid of buying a fake piece of art, such a behaviour is perceived by me as very unprofessional and untrustworthy. Above all, I still cannot understand why any piece of art shall take 4 weeks to ship if it's available at the partner gallery and why a purchase is cancelled straight away after mentioning to contact Artsy and questioning the shipping period - I never asked to cancel the purchase, actually. At least not until the last point of our conversation - I would have probably done so later.
I also want to highlight, however, that Peric/Pinto Gallery responded quite quickly and friendly throughout the process and that they contacted Artsy themselves so that I could receive my refund.
Nevertheless, if all this was just through a mischance I, in the place of Pinto Gallery, would do everything to avoid that something like this happens again and to give my customers the feeling of a respectable and trustworthy gallery.
