I came in for a short term marriage (23 months) contested divorce. No children. No assets with any positive equity for either party and no large wage gap for either party. Produced every single bank and credit card statement in under 7 days of filing and explained to firm I needed help on financial affidavit being sure to seperate business and personal expenses correctly. The firm clearly saw this case could be done and over quickly. Rather than help with affidavit they used my lack of understanding on how to do it at that time to avoid helping me and charge for unneccessary things such as $50 to email client asking if affidavit was ready. $48 to tell attorney affidavit is not ready $48 to email client asking if they could answer a phone call at certain time and so on for over 2.5 months straight. Then when confronted about the lack of help for financial affidavit the firms response was because my 2022 tax return was not finished we cannot help you with affidavit yet the tax return is not neccessary to do affidavit when all financial bank and credit card statements are available. I took my complaints to Tom Marks telling him I hoped he could be a voice of reason as the firm owner only to be quoted Abraham Lincolns quote of something close to lawyers only stocks are time and knowledge. Then to avoid answering billing questions Mr. Marks said he heard enough and that I talked over him although the talking and listening ratio were very very equal between us both. I believe he used this way of talking because he did not want to have a genuine discussing of the billing. He later emailed me that the billing stands then bullied me to sign papers to remove his firm from my case by his firm not handing over my financial affidavit that I finally did complete and notarize to opposing council and clerk of courts. This forced me to have to sign consent to let the firm withdraw as my council and submit papers myself. Even with the many financial transactions I have the time for the firm to discuss them with me and complete the form under their guidance would have been way less even at attorneys rates of $400/hr. I was billed over 5k and had no financial affidavit help and no mediation scheduled. The firm when confronted again about affidavit help said I did not get help with affidavit because I travel for work too much yet not one time when I was a grown man begging for assistance on it did they offer an in person sit down, video call, or phone call to go over the transactions on my submitted financial statements and help me.complete the affidavit. Instead they piled on time and charges for unprovable and unnecessary "work". I am still in shock with Mr. Marks' behavior towards me as I would be out of business if I treated my clients that way. Read moreI retained the marks law firm, attorney AJay fowinkle because I liked what they had to say in regards to my situation. Unfortunately, they did NOT do anything to help me. I wasted 4 1/2months of time and $2500! I hired them for termination of parental rights and after being retained, it took AJay 3 wks to even contact the other party! I feel 5-7 days is sufficient enough. Then after speaking with the other party they were supposed to be called again to confirm their response after 3 days. This turned into over another week. The other party agreed and the documents that need signatures were not presented to the other party for almost a month after they said yes!! This is unacceptable! Then, they filed Orange County paperwork in POLK county!! They did not ever fix this! I was calling and emailing weekly. At least 2x a week and at first they kept telling me there was a filing error that needed to be fixed with the clerk. (Filing in the wrong county) then towards the end of June they just stopped responding to me. They filed the documents on 5/17 and I had to hire another lawyer the second week in July because AJay never fixed their mistake. They kept telling me it was transferred and it was not! I had to call Orange County clerk myself to confirm there was no transfer in order to get AJay to dismiss the case! Which he told me on a Thursday in July it was going to be prepared and filed!
