I am writing to lodge a formal complaint regarding an incident I experienced at a McDonald's store in [Bondi Junction] on [28th Nov 2024]. I believe that the actions of the store’s management From Sandy may constitute misleading conduct under the Australian Consumer Law (ACL), and I would like to seek your assistance in resolving this matter. I visited the McDonald's store and placed an order for a meal, paying the full price. Upon receiving my meal, I requested an additional five packets of salt. The store manager, identified as Sandy, provided me with only two packets of salt. When I asked for three more, the manager informed me that two packets were the maximum limit, stating that “everyone knows about it.” This restriction on the number of salt packets, however, was not disclosed on the menu, nor was it communicated to me at any point during my order or payment. I am concerned that the actions of McDonald's in this instance may be misleading, as: Lack of Clear Communication: There was no indication on the menu or in-store signage that a limit of two salt packets applied. As a customer, I was unaware of any such policy, and the manager’s statement that “everyone knows about it” is not a reasonable justification for failing to clearly disclose this limitation. Misleading Information: By not providing clear information about this limitation, McDonald's created confusion about what I was entitled to receive with my purchase. A reasonable consumer, such as myself, would expect to receive a reasonable amount of condiments, including salt, to accompany their meal without arbitrary restrictions that are not made clear at the time of ordering. Potential Violation of Consumer Rights: The failure to communicate the policy transparently may be a violation of consumer rights under the Australian Consumer Law (ACL). The ACL prohibits businesses from engaging in conduct that is likely to mislead or deceive consumers, and I believe McDonald's actions could be seen as misleading under this provision. Given that I did not receive the level of service or information I expected based on my order, I am requesting that NSW Fair Trading investigate this issue. Read moreLast Tuesday, on 29/01/2019, I first make an order through the McDonald's app. At that time, I still consider it a good way to make an order. However, the app said that one of my order's drink is not available at that time. But when I decided to delete the item. I found out that I can not do so. Even worse, I can not even make a new order if I can not cancel the previous one. After 10 M try, I gave up. Then I search help from the front desk. However, even the manager don't know how to operate the app. At last, I don't know what happen, Just that the manager use my mobile phone to select something and he told me that the only way he can do is to completely delete the deal. I said OK. And he said that he would reorder it for me in the front desk and he has successfully delete my previous transaction. So I paid the order number 181 for 4.95 dollar, got 1 large fries, 1 cone and 1 sundae. Then I found out that the app charged me for the previous order, which the manager said that they have deleted. But the manager said no worry, the money will be refunded to me in two days. I believe him. However, after one week, nothing is back. Then this Monday I came to this store to require my $6.1 dollars back, with extra charge for the unavailable item to my actual order, but they refused. Last week, they said it was cancelled and then they still double charged me. And then they guarantee to refund me but it fails. This week I came for them they said there is nothing they can do because the app is not in there control. You can imagine how angry I was. Their guarantee means nothing. Maybe I was wrong.
