On June 13th 2020 I entered in to subway Restaurant #46726 located at 217 Forest Ave, Glen Cove NY in the Stop and Shop center. Upon entering the store I was accosted by a Subway employee who stated I must wear a facemask when in the store. I politely stated I was medically unable to tolerate a facemask therefore could not d0 so. The employee who I believe to be a manager stated she would not serve me and I was to leave the store immediately. I brought to her attention that New York State Executive order 202.34 stated in part that store policies of enforcing Executive Order 202.17 “shall be in a manner consistent with the American with Disabilities Act or any provision of either New York State or New York City Human Rights Law, or any other provision of law”. In return she was openly discriminating against a person with disabilities. At a minimum she could have offered to take my order and bring it curbside, instead she did not offer any other accommodations. I find it disturbing that an establishment can openly violate New York State Legislative law, and openly discriminate against a person(s) with disabilities without remorse. I am not one to take legal action against an establishment, but when communication fails with a said establishment what other course can one take to rectify the problem while protecting my rights and the rights of others who have disabilities too?
Update June 14th 2020 I spoke to the owner who was very understanding and was aware of the situation. He mentioned to me his store does do curbside delivery to accommodate people like myself, and people who just rather not go inside the store. He also mentioned he receives complaints about customers seen in the store who are not wearing a mask, by customers who do wear a mask. I understand his frustration trying to accommodate the needs of his customers during a time when the general public bases their actions and choices on fear rather than facts and the law. My son and I experience tonight at our local Subway in Glen Cove on Forest avenue was by far the best experience we have ever had. We were immediately greeted upon entering with a very friendly smile from a worker named GABBY. Her interactions with my son and I were beyond words. She prepared our food with caution and care. Gabby is definitely a model employee and Subway should be proud that she represents them in the manner that she does. GABBY the professionalism you had when taking our order and the interactions with us will get you far in life if Subway is smart they will do whatever they can to hold on to an employee like you!!! I will be contacting the number on the receipt also to express to Subway but thanks and gratitude we have for having such a wonderful employee like Gabby whereas we've experienced many employees being that Subway is our favorite place to eat that aren't as greeting aren't as kind aren't as caring thank you Gabby for making our night!!!!
