Renting a slip? Beware! Part 2:
Six months later (yes, six!) I got a series of phone calls in one afternoon from the marina office and from Danny. The frequency and urgency of the phone calls was interesting, since I hadn't paid in six months. When I called the office I was advised that I was six months late paying my slip. I advised the person that I spoke to that I was not late, that my lease with them had expired almost two years before and that I had frequently asked for a new lease, which I was not provided. I stated that I would be happy to sign a new lease, but that I would not be paying six months worth of slip fees for a slip that my boat hadn't been in for more than a year, and one in which the lease had expired two years before. Danny verified that my boat hadn't been in the slip that amount of time. I recounted all the times that I had requested a new lease and all the excuses I was given. I was told that they didn't have the ability to conduct "forensic accounting". I asked why forensic accounting would need to be conducted? Just take a look at when my lease expired, and look at how many months and how much money I paid for a slip in which I had no lease and no boat in. Everyone involved in the operation very much knew how I felt about that slip. I once again advised that I would be happy to sign a new lease and bring my boat back, but the payments would start with the new lease, not with this imaginary amount they stated that I owed. At one point the woman stated that it shows I owe in the online portal, so that must mean that I owe and that no other work by employees would be necessary because the computer is what they go by. Also my other favorite - "I can't override what the computer says." I then received this email: Thank you for bringing this to my attention. Unfortunately we will not be able to continue with you renting the boat slip, after 5 months of not paying for the boat slip and claiming you do not owe anything. It's best we part ways. I wish you all the best in finding a marina that can accommodate your needs. Thank you, Phyllis
This is hysterical because as I had multiple discussions with multiple employees about this situation and every step along the way everyone there knew I wanted a new lease. In our phone call, dear Phyllis even stated that Danny verified that my boat hadn't been in the slip in more than a year, and verified that she saw that I paid beyond that without a lease. But, you know - the computer says it's true so it must be so. I asked to be provided with proof that I signed a lease and I owed money, as I most certainly did not. They would not communicate with me further on the matter. We were pretty shocked, as I've never had a legitimate business handle a matter that way. My husband and I rented a slip here for years. When we considered moving to Eustis, one of the reasons we chose our home was because it was within walking distance of the marina. We loved the slip we had; we were in the very front at the edge of the dock without any obstructions, which made for picture-perfect sunsets. One day there was a storm, and the wind was pushing in so that my boat was banged against the dock and damaged. This was through no fault at all of the marina, it's just something that happened. Actually, Danny, who manages the marina, kept an eye on our boat during the storm and even put additional fenders out. We were very appreciative of that. We pulled the boat out of the slip to do the necessary repairs, and I continued to pay the slip fees. Life got in the way due to our work schedules, and we never got around to fixing our boat. However, I continued to pay the slip fees.
I called the leasing office multiple times and also left multiple messages for two employees (Charles and Amber). My lease had expired while my boat was out of the water, and I didn't want anyone to think the slip was vacant and for it to be rented to someone else. I continued to pay on the slip and followed up on numerous occasions about getting a new lease. I was given so many excuses - "There is only one person who leases here, and he's not available right now." "Oh, the person who does our leases changed the lease, and we can't find the original document to put it back the way it was." "We'll get back to you shortly with the lease." "Oh we redid the lease, and its in your online portal." (It was not.) And on and on and on the excuses went.
I repeatedly stated that I was concerned, because I continued to pay on a slip without a lease, so I was basically giving them free money. Additionally, once the marina restaurant opened, we would frequently drive by and see boats docked in the slip we continued to pay on. I stated repeatedly that there was only so long I could continue paying while the can got kicked down the road and I didn't have a lease. Read moreThe Marina has been redone and is very nice. The new restaurant just opened. Have been looking forward to having another restaurant on the water accessible by boat. Unfortunately the service and food needs some help. Lost the in person reservation, food was over cooked, and service was slow. Hopefully they will get it together soon
