While purchasing some funk pops the cashier offered me a store membership and a 3 free magazine offer. Declining his offer saying "I dont want my debit card or my info attached to any offer or subscription. I couldn't tell you the year I last touched a magazine.". Feeling vulnerable because my card was used on the purchase. I asked him to confirm that he understood i dont want any trial or membership whatsoever. He reassured me that I have no obligation or commitment an was not entered in offers. Continuing small talk as he completes my transaction. He asked me what magazines would have i choosen if I did take the offer. He then asked me to sign the digital pad in order to complete my purchase.There is nothing to inform you of what your signing. But I signed. Trusting that this was legitimate step in making a purchase at FYE. A few days later while pulling my funko pops out the bag. I seen 2 receipts. Looking over them I noticed one of the receipts was confirmation that I am now in a subscription. This is when I realized the cashier used his position to illegally bind me into a contract illegally an without my knowledge. Even after i told him i have no interest whatsoever. I then started the process to cancel any actions done by the FYE casheir fraudulently/illegally. Only getting busy signals when dialing the numbers given to opt out. I had to call FYE customer service. The customer service representative was consistently trying to get me to take the subscription anyway. Although refusing to take no for a answer. He assured me I've been canceled from all memberships or subscriptions without out penalty or cost to my debit card. Finally giving me a cancel confirmation code. Do to the ill intended actions an misinformation by the cashier. Then the customer service representative who even after being told that the contract was illegally entered by a FYE cashier(a cashier who maliciously and fraudulently used his position to illegally enter the customer into a binding contract for a set amount of time without the customer's knowledge and consent) was still adimenent that I should continue my contract an to rethink my decision to cancel. I picked my two plushies and at the register the male manager (who Iâve also conversated with multiple times in the past, forgot his name but know he used to work at the express outlet and other stores in the mall) he asks if I want an extra 10% off my purchase and that I just need to sign up for their âCOMPLETELY FREEâ sign up. I even asked him again are you sure this is all free and he says yes completely free. He only asked for my name, email, and address. Fast forward to this month, why did I get a 11.99$ charge for VIP membership on July 12th and another attempt this morning on July 22nd? For the cherry on top, the little âVIP coupon bookâ he gave me, all the coupons EXPIRED DECEMBER 2023. So not only did this guy who has been working at mills for years lie to me about a customer sign up and gave me 3 not very great and expired coupons, but that would mean this company takes card information without your consent, and the employees could likely also have easy access to customer information. It just disgusts me that the manager and his employees care more about getting a commission and signing up people by lying to them vs simply being honest sellers and telling people itâs a trial. Hopefully the managers and employees at this FYE are aware that legal action can be taken on them because of what they are doing
Edit: I had went back in to approach this same manager about the issue and how it charged me and how I had to cancel the subscription and he played dumb and took me to the register to âcheck my accountâ even though I already said I had to cancel it on email, just sat there at the register and he said âyep itâs all canceled now, and your coupons will still work donât worry.â I told him to watch what heâs doing to people and he just gave me a straight face and turned back to âwell your coupons still work.â So these people 100% know what theyâre doing and donât care. As others state, this store and company runs a predatory scam where they fail to disclose to you that their 'rewards' program is in fact a paid membership. Sneaky small print in the booklet they slip in your bag goes on to say you will start getting charged for their perks. After canceling their program I was told that I was done with them. Today, 2 months later, I received a pending charge from mags.com for a Rolling Stones subscription I was unaware I held. Guess who signed me up and passed along my financials to mags.com...FYE. So if you canceled their bogus 'rewards' program just know you will probably need to cancel and dispute charges with any third parties that they slipped your card info to.
I will never step foot in your stores again. Your staff run predatory tactics to sign customers up without verbally disclosing or even hinting that the company will charge you for a membership. They let the fine print in the tiny booklet tell you that when you get home, probably hoping it goes un-noticed and thrown away. Ice their BS cake with the fact they also share your financial information to a third party that will charge you on their own and will require their own cancellations.
