Read moreJosh Rubin's team was hired by me to sell my NYC co-op in spring of 2019 and represented me at the closing. He completely failed to act on my behalf when a member of his team signed a sloppily written addendum to the contract that tied up $1000 of my money for eternity. I did not authorize this, but they had my Power of Attorney for the closing. I had already relocated to Florida and was not available to attend the closing, and sadly I trusted that Josh's team would act in my best interest.
The issue was a light fixture that did not work at the walk through. The purchaser never repaired the fixture and there was nothing in the addendum that released the funds unless she produced an invoice for reimbursement to the settlement attorney. If the light fixture was not repaired, the funds sit with the attorney forever. It has been a 18 months since the closing and the purchaser has not fixed the light and she has recently listed the co-op for sale. I have no ability to ever access the money.
I have several issues: 1. $1000 of my proceeds was held for a light fixture?? 2. The addendum has no timeline and does not address what happens if the light is not repaired 3. Josh's disappearing act once he received his commission.
Josh was very responsive until the deal closed but has been absent regarding this problem once he received his commission.
