This is a warning, a cautionary tale so no one else has to go through what we have been going through
My wife and I, moved into a one bedroom apartment just before Christmas in December of 2024.
We had looked at so many other apartments in Philadelphia before we pulled the trigger on the Atlantic, and we were both looking forward to living in this beautiful building.
If we had only known, just how much emotional distress, anxiety, and frustration was awaiting us here at the Atlantic, and especially if we had known that the Landlord was deliberately misleading us about one very specific fact about our apartment, in order to induce us into entering into our lease agreement.
We would have never entered into that lease agreement with the Landlord, and moved into the Atlantic Building here in Philadelphia.
The Atlantic is owned by Post 260 Property Owner LLC, and Post Commercial Real Estate LLC. Which is one of Post Brothers Properties.
So exactly what is it that I am talking about?
Two things, and the first thing brought us to discover the deliberate and false misrepresentation of the second thing.
First thing, almost immediately after moving in, we started to smell the extremely strong odor of marijuana in our apartment. We determined it was coming from the tenant next door.
It became a total nightmare for us, obliterating our quiet enjoyment, and habitability of our apartment. It even drove us out of our apartment and into a hotel at one point.
Well it's now May 19th, 2025, and even though they know its the tenant, have witnessed it for themselves in inside our apartment, and caught him in the act, the Landlord has yet to remedy the situation, or remove the tenant who is in breach of his lease, and restore the quiet enjoyment, and habitability of our apartment.
Ironically, you can even find a one star review right here in the Atlantic Google reviews by Robert Fitzgerald, who is the previous tenant who lived in our same apartment before us, who also complains in his review about smelling marijuana in the apartment from the same tenant next door.
So here is where the second issue comes into play.
The apartment that we rented was always represented to us, and told to us to be 700 square feet. It's in all the emails received from the Atlantic, was also always verbally communicated to us to be 700 square feet, and it is listed as 700 square feet on the website as well.
At no time were we ever informed or told that it was anything other than 700 square feet.
We found a huge discrepancy in the actual square footage.
So to be sure of what we found, we hired a professional licensed real estate appraiser, who confirmed to us that the actual Square footage of our apartment we rented is actually 528 square feet. Thats a 25.5% discrepancy.
Meaning the landlord was overcharging us for rent by just under $9000 a year.
We even found a lawsuit filed against the Landlord, Post 260 Property Owner LLC in August of 2021, by another Tenant in our same one bedroom layout, five floors above us, for exactly this same false misrepresentation of the square footage.
He won his lawsuit and received a judgment against landlord, yet even though the Landlord has known since losing that lawsuit that the apartment is not in fact 700 square feet, the landlord is still deliberately misrepresenting the square footage to be 700 square feet and not its actual 528 square feet.
There is over one hundred of these one bedroom apartments in the building
Even when we confronted management about this square footage issue, they just basically blew us off.
Here are some of the key elements that must be established in order to prove fraud.

When we moved in in April 2019, it was brand new and they were still constructing many of the units on the lower floors (but the walls are so thick there was no noise!). Of all the apartment buildings I've lived in in Philadelphia, this building is BY FAR the best one. PROS: Wonderful management and staff. Kristen Mauro, the property manager, is professional, responsive, and helpful in dealing with any issues. Everyone who works at the desk downstairs is friendly and kind. When I first moved in, my unit wasn't ready so they upgraded me to a 2 bedroom. When my unit became available during the pandemic, they allowed me to stay in the 2 bedroom for several extra months. They were also really welcoming and accommodating when I got a puppy having given them zero notice. The amenities are amazing and never overcrowded. The rooftop pool and hot tub area is STUNNING. They also have a really great women's locker room with a sauna, tanning bed and massage chair that no one ever uses. Everything is impeccably clean. They'll bring packages or deliveries up to your unit and have never lost a package. Also, the commercial-sized washer/dryer and storage area is very functional. Of course, the location is good as it's right on the corner of Broad & Spruce (a chaotic area but that's all of Center City). Also, can't forget the dog park on the roof. CONS: Rent is high. Many of the amenities weren't ready on time and/or not open during the beginning of the pandemic (not an issue any longer). We had issues with some of the appliances not working (ice machine, in-unit washer/dryer, stove) and because they are energy-saving appliances, it is a pain to figure how to use them properly. You have to buy special pots and pans for the stove. Also we were under the impression that we could rent out the entertaining space on the roof and this (absolutely gorgeous!) lounge downstairs for parties but weren't told that it is (a) crazy expensive and (b) they don't allow you to rent for more than a few hours and only on certain days (not on Friday or Saturday night, for example). Also, if you have a pet, its not the best location for walks but the dog park helps. Overall, this is the best apartment building in all of Philadelphia and I highly recommend it. Ā Ā Ā Read moreI am going on four years at the Atlantic, and when I say it truly feels like home, that begins with the staff wishing me a good day and upon my return saying to me welcome home.
The thought of leaving this place brings tears to my eyes, mainly from the friendships I made within the building, the amazing staff and genuine care that I have experienced. I lost my father coming up on two years and from the concierge team to the doormen to management, everyone expressed their sympathy and gave me much needed hugs and checking in on me. I don't know how I would have gotten through this tough period working from home in isolation due to covid - again the wonderful friendships that I made here really helped me pull through some dark moments.
I know many people commented already on the amenities, which they are all 100% correct, we are spoiled living here, but honestly, it feels like a community and leaving that behind is something that I would truly miss more than the amazing hot tub/pool and gorgeous gym.

Thank you to Angela for being a fantastic property manager, who in her short time has created relationships with each of us, listening and addressing our concerns. Honestly, everyone here brings a smile to my face. I do not have one complaint whatsoever aside from the gaggle of illegal ATVs and dirt bikes that make so much noise I literally want to get a bb gun and pop their tires - but even with that nuisance, I wouldn't trade...
