I had the misfortune of being rear ended and flipped over into the ditch in a MVA in the summer of 2021. My Toyota was totally crushed on every angle -top, sides, back, front, underneath from 3 high speed impacts from being rear ended, being spun and crashing again backwards onto Big boulders in the ditch, making second impact cause the car to fly up in the air and flip upside down for a third crash onto more big boulders in the ditch. It was a miracle to regain consciousness and slowly crawl out of the wreck and have TBI level 2 concussion and whip lash soft tissue trauma to my neck and spine. The crash was caught on the security cameras of the nursery that I was going to so the video showed the time of when I was rear ended by an elderly person going at speeding velocity and the minute and a half before I started to regain consciousness and help was arriving to assist me out of the vehicle. I am so lucky that I didnât die of a brain bleed or smashed internal organs. Brain bruising, swelling, sensitivity to light and sound, and need to rest for months to let the brain slowly heal is an ordeal to get through. Premature jostling of a bruised concussed brain can lead to long term damage like early onset Alzheimerâs. Soft tissue trauma to the spine from being whipped around with three high speed crash impacts was challenging to slowly and gradually recover from. A friend referred me to Kimberly Weingart and I am grateful for her legal support negotiating with the insurance companies to obtain a decent settlement compensation for my losses and injuries. I could focus on the big job of healing when I could trust her skillfulness in negotiating for me. She was excellent in compassionate listening, attention to detail, communication with me to work together on strategy for important choices and positive diplomatic focus for most favorable outcomes. Ethics of personal integrity are so important in sticking up for oneself for the hard work of recovering from traumatic injury and loss. Insurance companies are like sharks to try to weasel out of fair compensation for a personâs medical trauma. Kim was great with being diplomatic and tough, fighting for me and keeping my recovery and wellbeing as number one priority. I highly recommend her. I turned 65 during this so Kim also did a great job navigating red tape in advocating for me and negotiating with Medicare and Medicaid about both my rights and their rights in regards to medical compensation...
Read moreIn 2016 I was in a motor vehicle accident where an impaired driver struck me head on. On the advice of a friend, I reached out to Kim at Pickett Dummigan McCall to discuss my options and made the decision to have her represent me. Not only was she knowledgeable about the process and the various laws and statutes relevant to the case we pursued, but also extremely communicative about what to expect as we moved through the process and where the case was - I received updates during the discovery process, when depositions were happening, or when hearings were held to determine the specifics of how the case was being tried. In my case there were also some personal circumstances involving a disabling condition I've had all my life. Kim, took the time to understand what limitations were from the condition and what differences/changes were post-accident. She was sensitive enough to let me make my own decisions regarding how certain aspects of the case were addressed, but firm enough to help me understand that some of the processes are simply things you have to go along with if your case is going to move forward. Kim and her team addressed various motions throughout the case process, including a motion by defense counsel for summary judgment and dismissal, which was denied. Every case is different and unique. Over my time working with Kim I had no doubt that her interest was in achieving the best outcome possible for me, which all things considered, she did quite well. The staff was helpful and it was a...

When people think lawyer, many things come to mind. After my husbandâs accident we felt lost and confused about what to do and where to turn for help. Everything was new and different from our normal day to day, and we were struggling to grasp this new world. But from our first phone call to the offices of Pickett Dumigan Weingart that found us speaking with Gary Pickett, it was clear they truly care about the people they work with and intimately know the law that protected our rights. It was as if we had found family who would take our hand and guide us through this complicated process. They were always by our side, explaining what we needed to know, easing us through each step to ensure they had what they needed to do their best work for us, and that our questions were always answered. They used their expertise to achieve best outcomes on our behalf. We couldnât have been in better hands and are so thankful to have found a team that made us and our well being a priority.
A sincere thank you to our team, Kim Weingart, Kyle Sharp, Amanda Fitzhenry, Rachel Kacalek, Maura Wood, Gary Pickett, and all of those at the law firm involved in our case that I have missed naming.
