Statement of Incident – January 13, 2025 Location: Checkers, Cape Coral, FL. Approximately 12:15-12:30
My name is Jerry Moore. I reside at 2314 N.E. 5th Terrace, Cape Coral, FL, 33909. I own a sprinkler repair business, and on January 13, just before noon, I visited John Deere Landscape Supply to pick up materials. While there, I overheard a conversation among the workers about being hungry, and one of them mentioned the new Checkers restaurant. I commented that I had been there and liked it, as it’s one of my favorite spots.
Shortly afterward, I decided to go to Checkers to buy lunch for the workers.
When I arrived at Checkers, I noticed three people near the building: a heavyset woman, a man in dress pants and a shirt, and another man dressed in Checkers employee attire. It appeared they were having a meeting.
I proceeded to the drive-through and ordered five number one meals, all with lettuce, tomato, onions, and pickles. I asked for the condiments (ketchup, mayonnaise, and mustard) to be placed in cups, not directly on the burgers, and requested each meal be packaged in individual bags. I clearly explained my instructions to the man taking my order, and he confirmed, saying, “No problem, sir.”
At the window, the same woman I had seen earlier rushed up and asked the employees, “Are you ready?” She then turned to me and said, “Sir, please pull forward to the parking space, and we’ll bring your order out.” I held up my money, and she took my payment before directing me to wait by the other window.
I complied, parked, and waited. A young man soon brought me five drinks. Moments later, the same woman approached with two bags of food.
When I checked the order, it was incorrect—all the meals were packed together, and the condiments were on the burgers instead of in cups. I politely explained that this wasn’t what I ordered and asked her to separate the meals and provide the condiments in cups.
Her response was dismissive: “I’m not going to do that. I’ll bring you some bags.”
I said, “No, I’m not accepting this.” I got out of my van, walked to the window, opened it slightly (it was already ajar), and held up the food bags, saying, “This isn’t what I ordered.”
At that point, the woman rushed over, shoved the bags away, and forcefully slammed the window, which hit my arm, causing a minor cut. She shouted, “We’re not taking the food back!” and yelled, “Call the police!”
I pulled out of the drive-through and waited nearby, since they had both my food and my money.
A police officer soon arrived. He asked if I was the reason he had been called, and I said yes. When I began explaining what had happened, the same woman ran out of the building, shouting, “I want to press charges!” and making loud accusations.
The officer immediately focused on her and entered the restaurant without hearing my full explanation. A second officer, Officer Carol, arrived, and I calmly shared my side of the story with her.
There were two women seated outside who had witnessed the incident. While Officer Carol asked them about what they saw, the first officer showed no interest in speaking with them. The witnesses confirmed that the woman had been aggressive and confrontational, but this did not seem to influence the officer’s attitude.
At no point did I throw anything, touch anyone aggressively, or intend any harm. The only physical contact occurred when the woman pushed into me and slammed the window on my arm.
This is a truthful and accurate account of what happened, to the best of my knowledge.
Signed, Jerry...

They had closed down the lane that is usually used for delivery drivers but after they could not find my 2nd order decided to have me wait over on the other side stuck behind another car who they also told the same thing to. After 25 minutes waiting in that line I called the store in hopes he could tell me what was going on but no answer. I watched the guy infront of me go up to the window and could see his frustration especially when he was being ignored. He finally got his food 10 minutes later. I go to the window in hopes to see my food being made but the employees were all the way in the back. I knocked on their window a couple times and they made their way back up to the front with both of them on their cell phones so I knocked again with him no more than a foot away and he didn’t even begin to look at me so I then opened the window and asked if there was an issue I needed to know about when he rudely said we gotta cook the food dude damn and proceeded to slam the window on me. If I managed that store they both would have been fired long before I arrived. They were not only rude but give checkers a really REALLY bad name considering everyone in line looked pissed off and probably won’t be back. I WILL NEVER GO BACK TO CHECKERS. This is far from the only location. I have been to two others and they are just as bad. I vote for them to close all locations because this problem seems to be a Checkers problem and the way the are trained as in ts a free for all do whatever you want . That’s one of the worst experiences you can have at a fast food...

They were only one fish fillet in each sandwich. It should have been two! 3) the fish did NOT even taste like fish. It was either dog food, cooked in bad grease, or something gross!! Not any cheese on either sandwich! This was the WORST fast food I ever had. You employees had best be saving some money up. You’ll be out of a job fast...
